THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show award of the Combat Infantryman Badge. 2. The applicant states that he served with the 5th Battalion, 60th Infantry Regiment, 3rd Brigade, 9th Infantry Division in the Republic of Vietnam (RVN). He was the senior company clerk, but he also occasionally served in the field as a rifleman. a. He states that this information was documented by the men of Company A with whom he fought alongside. He adds that he was involved in the following firefights: Plain of Reeds, Dong Tam, Ben Tre, An Nhut Tan, Ben Luc, and Peoples Road. b. He also states that he has attempted to contact former members of his unit (whom he identifies), but he has been unsuccessful in his efforts. 3. The applicant does not provide any additional evidence in support of his request for reconsideration. CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20110004040 on 1 September 2011. 2. The applicant enlisted in the Regular Army on 28 September 1966. He was awarded military occupational specialty (MOS) 71H (Personnel Specialist). 3. The applicant's DA Form 20 (Enlisted Qualification Record) shows, in pertinent part, in: * item 31 (Foreign Service): Vietnam from 18 January 1969 through 26 July 1969 ETS (expiration term of service) * item 38 (Record of Assignments): * Duty MOS (DMOS) 71H2O, Personnel Specialist, Headquarters and Headquarters Company, 5th Battalion, 60th Infantry, 9th Infantry Division, from 30 January 1969 through 14 July 1969 * DMOS 71H2O, Personnel Specialist, Battery A, 3rd Battalion, 34th Artillery, 8th Infantry Division, from 15 July through 26 July 1969 * item 41 (Awards and Decorations) does not list the Combat Infantryman Badge * item 48 (Date of Audit): 24 July 1969 4. A review of the applicant's military personnel records failed to show any evidence that he was awarded the Combat Infantryman Badge. 5. The applicant's DD Form 214 shows he was honorably released from active duty on 27 July 1969. * Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) does not show the Combat Infantryman Badge * Item 32 (Signature of Person Being Transferred or Discharged) shows he placed his signature on the document 6. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. It shows the Combat Infantryman Badge is awarded to infantry officers and enlisted Soldiers who have an infantry MOS. They must have served in active ground combat while assigned or attached to an infantry unit of brigade, regimental or smaller size. 7. U.S. Army Vietnam Regulation 672-1 (Decorations and Awards), Appendix V, shows that during the Vietnam era the Combat Infantryman Badge was awarded to enlisted Soldiers who held and served in MOS 11B, 11C, 11D, 11F, 11G, or 11H. DISCUSSION AND CONCLUSIONS: 1. The applicant's request for reconsideration was carefully considered. 2. Records show the applicant was serving as a personnel specialist (MOS 71H) during the period of service under review. 3. The applicant's DA Form 20 fails to show award of the Combat Infantryman Badge. He reviewed the DA Form 20 on 24 July 1969. 4. His DD Form 214 fails to show award of the Combat Infantryman Badge. He reviewed the DD Form 214 on 27 July 1969. 5. There is no evidence of record that shows the applicant held an infantry MOS or that he was awarded the Combat Infantryman Badge. 6. Therefore, in view of the foregoing, there is an insufficient evidentiary basis upon which to grant the requested relief.
