THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show in: * item 12f (Foreign Service) almost 2 years vice “0000--00--00” * item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) the Iraq Campaign Medal and Army Good Conduct Medal 2. The applicant states he served in Afghanistan and Iraq on two different deployments and had almost 2 years of foreign service. His DD Form 214 is also missing the Iraq Campaign Medal, Army Good Conduct Medal, and his foreign service in item 12f. 3. The applicant provides: * his DD Form 214 * a memorandum for record (MOR) * North Atlantic Treaty Organization (NATO) certificate * four orders, dated between 7 May 2010 and 13 February 2013 * DD Form 2796 (Post-Deployment Health Assessment (PDHA)), dated 4 May 2011 * DD Form 1351-2 (Travel Voucher or Subvoucher), dated 15 June 2011 CONSIDERATION OF EVIDENCE: 1. The applicant's records show he enlisted in the Regular Army on 13 June 2007 and he held military occupational specialties 91B (Wheeled Vehicle Mechanic) and 92G (Food Service Operations). 2. He provides a certificate that shows he was awarded the NATO Medal for his service with NATO in relation to the International Security Assistance Force operation [in Afghanistan] from 8 January 2008 to 31 January 2009. 3. He was promoted to the rank of specialist (SPC) on 1 April 2009. He was subsequently assigned to the 403rd Inland Cargo Transfer Company (ICTC), 330th Transportation Battalion, 82nd Sustainment Brigade, Fort Bragg, NC. 4. He provides: a. Orders BG-127-0024, dated 7 May 2010, issued by Headquarters (HQ), U.S. Army Garrison, For Bragg, deploying him to Iraq in support of Operation Iraqi Freedom (OIF) with a will proceed date of on or about 11 June 2010. b. Permanent Order (PO) 130-005, dated 10 May 2011, issued by the 352nd Combat Sustainment Support Battalion, Joint Base Balad, Iraq, awarding him the Driver and Mechanic Badge with Mechanic Device for the period 21 June 2010 to 6 June 2011. c. An MOR, dated 2 June 2011, from the Commander, 403rd ICTC, Camp Liberty, Iraq, wherein it stated the applicant served in OIF and Operation New Dawn from 21 June 2010 to 2 June 2011. He was authorized to wear the Iraqi Campaign Medal, Global War on Terrorism Service Medal, and the Overseas Service Ribbon. 5. His record contains a certificate, dated 9 May 2012, wherein it shows he was awarded the Army Achievement Medal for exceptionally meritorious service from 17 February 2010 to 24 April 2012. The certificate shows PO 130-001, issued by HQ, 82nd Sustainment Brigade, Fort Bragg, awarded him this medal. 6. On 31 January 2013, the applicant's immediate commander recommended separation action be initiated against him under the provisions of Army Regulation 635-200 (Active Duty Enlisted Administrative Separations) for failure to meet weight control standards. His commander stated he: * was placed on the Army Weight Control Program (WCP) on 11 May 2012 and failed to make satisfactory program * had no record of trial by court-martial, nonjudicial punishment (NJP), any disciplinary action, or any lost time * had been promoted to SPC on 1 April 2009, had never been reduced, and there was no derogatory information pertaining to him 7. The applicant was honorably discharged on 28 March 2013 in the rank of SPC. He completed 5 years, 9 months, and 16 days of creditable active service with no lost time. 8. Item 12f of the DD Form 214 he was issued contains the entry “0000--00--00.” Item 13 shows he was awarded or authorized the: * Army Commendation Medal (2nd Award) * Joint Meritorious Unit Award * National Defense Service Medal * Afghanistan Campaign Medal with 2 bronze service stars * Global War on Terrorism Service Medal * Noncommissioned Officer Professional Development Ribbon * Army Service Ribbon * NATO Medal 9. Item 18 (Remarks) of his DD Form 214 contains the entry “SERVICE IN IRAQ 20080103-20081215.” It does not show the period of his service in Afghanistan. 10. His record is void of orders awarding him the Army Good Conduct Medal (1st Award). His record does not contain a commander's disqualification or record of a court-martial conviction or other adverse action that would disqualify him for award of the Army Good Conduct Medal. 11. On 15 October 2015, by email, a Defense Finance and Accounting Service (DFAS) official verified the applicant received hostile fire (HF)/imminent danger pay (IDP) for service in: * Afghanistan from 8 January to 20 December 2008 (11 months and 13 days) * Kuwait from 21 June 2010 to 8 June 2011 (11 months and 19 days) 12. Army Regulation 600-8-22 (Military Awards) states: a. The Iraq Campaign Medal is awarded to members who served in direct support of OIF. The Iraq Campaign Medal period of eligibility is on or after 19 March 2003 to 31 December 2011. A bronze service star is authorized for wear with this medal for participation in each credited campaign. A review of his records shows he participated in two campaigns during his service in Iraq. b. Overseas Service Ribbon is awarded for successful completion of overseas tours. According to the Awards Branch at U.S. Army Human Resources Command, Iraq and Afghanistan are considered isolated areas where tour lengths have not been established by the Department of Defense. Soldiers who serve 11 cumulative months in a 24-month period or 9 months continuous in Iraq or Afghanistan get credit for a completed short tour. c. Army Good Conduct Medal is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity during a qualifying period of active duty enlisted service. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of Federal military service of less than 3 years and more than 1 year. Although there is no automatic entitlement to the Army Good Conduct Medal, disqualification must be justified. Enrollment in the Army WCP does not preclude a Soldier from receiving the Army Good Conduct Medal. 13. Army Regulation 635-5 (Separation Documents), in effect at the time, stated in item 12f of the DD Form 214 enter the total amount of foreign service the Soldier completed during the period covered by the DD Form 214. In item 18, for a Soldier deployed to a foreign country during the period of service covered by the DD Form 214 enter “SERVICE IN (NAME OF COUNTRY DEPLOYED) FROM (inclusive dates for example, YYYYMMDD - YYYYMMDD).” DISCUSSION AND CONCLUSIONS: 1. PO awarded the applicant the Army Achievement Medal and the Driver and Mechanic Badge with Mechanic Device which are not shown on his DD Form 214. He meets the criteria for correction of his DD Form 214 to show these awards. 2. It is evident errors occurred when the applicant’s DD Form 214 was prepared as it showed in item 12f that he had no foreign service and in item 18 that he had served in Iraq from 3 January to 15 December 2008. It further shows he was awarded the Afghanistan Campaign Medal with campaign stars for serving in two campaigns. 3. DFAS confirmed he received HF/IDP for service in Afghanistan from 8 January to 20 December 2008 (11 months and 13 days), for service in Kuwait from 21 June 2010 to 8 June 2011 (11 months and 19 days), (a total of 1 year, 11 months, and 2 days), and the evidence of record confirms he served in Iraq from June 2010 to June 2011. It is reasonable to presume he arrived in Kuwait with his unit on 21 June 2010 where his HF/IDP was processed and he subsequently moved forward to Iraq with his unit. He meets the criteria for correction of his DD Form 214 to show his foreign service in Afghanistan and Kuwait/Iraq as confirmed by DFAS. 4. He served in Iraq during a qualifying period for entitlement to the Iraq Campaign Medal and participated in two campaigns during his service in Iraq. He is authorized 2 bronze service stars for wear on the Iraq Campaign Medal. 5. The evidence of record confirms the applicant served honorably from 13 June 2007 through 28 March 2013. He served in Afghanistan and Iraq and his record is void of any derogatory information or a commander’s disqualification that would have disqualified him from receiving his first award of the Army Good Conduct Medal. He meets the criteria for the first award of the Army Good Conduct Medal based on completion of a qualifying period of Federal military service. 6. Based on his service in Afghanistan and Iraq for over 11 months each, he served during a qualifying period for two awards of the Overseas Service Ribbon.
