THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) entered on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) item 32 (Remarks) for the period ending on 3 October 1957 from XXX-XX-xxx to XXX-XX-xxxx. 2. The applicant states his SSN is incorrect. He believes the error to be a clerical error. 3. The applicant provides a copy of his DD Form 214 and his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's complete military records are not available to the ABCMR for review. A fire destroyed approximately 18 million service members' records at the National Personnel Records Center in 1973. It is believed that most of the applicant's records were lost or destroyed in that fire. This case is being considered using limited documents in his official records and documents provided by the applicant. 3. On 4 October 1954, the applicant enlisted in the Regular Army (RA). 4. A review of his military service records failed to reveal any documents showing his SSN was recorded as XXX-XX-xxxx during his military service. 5. On 3 October 1957, he was honorably released from active duty service and transferred to the United States Army Reserve. 6. A review of the applicant’s DD Form 214 shows: • Item 2 (Service Number) - “RA xxx” • item 32 – Social Security Account Number (SSAN) as XXX-XX-xxx. 7. He provides his social security card which shows his SSN is XXX-XX-xxxx. The card was issued on 8 September 2008. DISCUSSION AND CONCLUSIONS: 1. The evidence shows the applicant's SSN was entered incorrectly in item 32 of his DD Form 214. 2. It appears that a clerical error combined the applicant’s SSN and his service number. Therefore, it would be appropriate to issue a DD Form 215 (Correction to DD Form 214) correcting item 32 of his DD Form 214 to show the SSN entered on his social security card.
