THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DA Form 3349 (Medical Condition - Physical Profile Record) to show the third digit of his social security number (SSN) as "6" instead of "1." The applicant also requests that this Board locate his medical records and provide him a copy. 2. The applicant states, in effect, the Fort Leonard Wood, MO, Hospital mislabeled his medical records with the wrong SSN prior to forwarding them to the National Personnel Records Center (NPRC), St. Louis, MO. 3. The applicant provides his DA Form 3349 and DD Form 214 (Report of Separation from Active Duty). CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant’s military records are not available for review in this case. The NPRC was unable to locate the applicant's military records upon request. However, the applicant provided sufficient records to conduct a fair and impartial review of this case. 3. The Board acknowledges the applicant's request for a copy of his medical records. The ABCMR is not the custodian of service personnel or medical records. Therefore, this portion of the applicant's request will not be discussed further in this Record of Proceedings. 4. The applicant's DD Form 214 shows he enlisted in the Regular Army on 12 January 1974 and the Army honorably discharged him on 11 January 1977. This form also shows the third digit of his SSN as "6." 5. The applicant provided a DA Form 3349, dated 28 May 1971. This form lists the third digit of his SSN as "1." REFERENCES: Army Regulation 635-5 (Separation Documents) in effect at the time provided guidance on the preparation of the DD Form 214. This regulation has historically stated that item 3 of the DD Form 214 will contain the SSN taken from the Soldier's personnel record. DISCUSSION: 1. The Board considered the applicant's request for correction of the SSN shown on his DA Form 3349. 2. The applicant provided a copy of his DD Form 214 that properly shows the third digit of his SSN as "6."
