THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show additional military training. 2. The applicant states, in effect, he completed the following training courses and would like them reflected on his DD Form 214: * Joint Services Interior Intrusion Detection System Monitor's Course (3 hours) * 40- hour Driver's Training * Unit Armorer Course (80 hours) * Airborne Course 3. The applicant provides: * DD Form 214 for the period ending 13 July 1987 * DD Form 215 (Correction to DD Form 214) * four training certificates CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 12 September 1984. 3. He was honorably released from active duty on 13 July 1987. His DD Form 214 shows he completed 2 years, 10 months, and 2 days of net active service. a. Block 11 (Primary Specialty Number, Title, and Years and Months in Specialty) lists his primary military occupational specialty as 36C (Wire Systems Installer). b. Block 14 (Military Education) shows he completed an 8-week Wire Systems Installer Course. No other military training is shown. 4. His available service record contains a DA Form 2-1 (Personnel Qualification Record - Part II). In item 17 (Civilian Education and Military Schools) lists the following military training: * Wire Systems Installer Course, 8 weeks * Basic Airborne Course, 3 weeks 5. The applicant provides the following training certificates: * Airborne Course Diploma showing successful completion on 7 March 1985 * Certificate of Training for successful completion of a 40-hour Driver's Training course (undated) * Certificate of Training for successful completion of the Unit Armorer Course during the period 28 October 1985 to 8 November 1985 (80 hours) * Certificate of Training for successful completion of the XVIII Airborne Corps Joint Services Interior Intrusion Detection System Monitor's Course (3 Hours), on 25 March 1986 6. Army Regulation 635-5 (Separation Processing and Documents), in effect at the time, prescribed policies and procedures for the use and completion of the DD Form 214. With regard to the block addressing military education, it stated to list formal in-service (full-time attendance) training courses successfully Full time training courses relate to those courses of at least 1 week duration or 40 hours completed during the period covered by the DD Form 214 Include title, length in weeks, and month and year completed. DISCUSSION AND CONCLUSIONS: 1. The applicant requests amendment of his DD Form 214 to show military training he completed while on active duty. 2. Most courses requested were completed and met the full time attendance standard during his period of active service. Therefore, it would be appropriate to amend his DD Form 214 as recommended below. 3 The Joint Services Interior Intrusion Detection System Monitor's Course completed in 1986 was a 3-hour course that does not meet the full time attendance standard. Therefore, there is no basis for adding this course to his DD Form 214. The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 for the period ending 13 July 1987 by adding to block 14 the following: * Driver's Training, 1 week (date unknown) * Unit Armorers Course, 2 weeks, (November 85) * Basic Airborne Training Course, 3 weeks, (March 85) 2 The Board further determined that the evidence presented is insufficient to warrant a portion of the requested relief.
