THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show in: * Item 12f (Foreign Service) – foreign service credit * Item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbon Awarded or Authorized) – the Global War on Terrorism Service Medal 2. The applicant states he served overseas with the Army in Bosnia. He believes his DD Form 214 should show the Global War on Terrorism Service Medal and his foreign service credit. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of the cases and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations. 2. The applicant enlisted in the Minnesota Army National Guard (MNARNG) on 25 April 1997 and he held military occupational specialty 19D (cavalry scout). He entered active duty in support of Operation Joint Forge on 19 July 2003. 3. His DA Form 2-1 (Personnel Qualification Record – Part II) – shows in: * Item 5 (Overseas Service) – he served in Bosnia from 29 August 2003 through 30 April 2004, a period of 7 months and 2 days * Item 35 (Record of Assignments) – he was assigned to Company A (Detachment 2), 2nd Battalion, 194th Armor Company, Bosnia, from 19 August 2003 through 30 April 2004 4. He was honorably released from active duty on 1 May 2004. His DD Form 214 lists in: * Item 12f (Foreign Service) – zero credit * Item 13 – the: * National Defense Service Medal * Armed Forces Expeditionary Medal * North Atlantic Treaty Organization Medal * Armed Forces Reserve Medal with "M" Device * Army Service Ribbon * Item 18 (Remarks): Service in Bosnia – 20030829-20040331 – Served in a Designated Imminent Danger Pay Area 5. He was honorably released from the MNARNG on 30 November 2004 and transferred to the U.S. Army Reserve Control Group. 6. Army Regulation 600-8-22 (Military Awards) states the Global War on Terrorism Service Medal is authorized for award to all Soldiers, including ARNG Soldiers, on active duty on or after 11 September 2001 to a date to be determined having served 30 consecutive days or 60 nonconsecutive days. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, governed the preparation of the DD Form 214. It stated the DD Form 214 would be prepared for all personal at the time of their retirement, discharge, or release from active duty. The regulation stated item 12f would list credit for all foreign service completed during the period covered by the DD Form 214. DISCUSSION AND CONCLUSIONS: The applicant served in Bosnia from 29 August 2003 through 30 April 2004, a period of 7 months and 2 days. He completed a qualifying period of service for award of the Global War on Terrorism Service Medal. This award and his foreign service are not listed on his DD Form 214.
