THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his already-awarded Army Achievement Medal (2nd Award) and the Army Superior Unit Award. 2. The applicant states: * he was awarded the second award of the Army Achievement Medal as an Expiration Term of Service award * his unit, the 529th Military Police (MP) Company, received the Army Superior Unit Award during his assignment 3. The applicant provides the lineage and honors of the 529th MP Company and a copy of an award certificate for an Army Achievement Medal. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 29 January 1992. 3. He was honorably discharged on 28 July 1997 due to completion of required active service. His DD Form 214 shows his last unit of assignment was the 529th MP Company. He was awarded or authorized: * North Atlantic Treaty Organization Medal * Armed Forces Service Medal * Army Achievement Medal (1st Award) * Good Conduct Medal (1st Award) * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * Air Assault Badge 4. His official military personnel file contains the following documents: a. Certificate showing he was awarded the Army Achievement Medal (1st Award) for the period 12 June 1992 to 30 July 1994 by Permanent Orders (PO) Number 22-02, dated 1 June 1994, issued by Headquarters Command, Fort Myer, VA. b. PO Number 129-005, dated 9 May 1997, issued by the 95th MP Battalion, awarded him the Driver and Mechanic Badge with Driver-W (Wheeled Vehicle) Bar for the period 1 January 1996 to 1 January 1997. He was assigned to the 529th MP Company. c. There are no orders or certificates for a second award of the Army Achievement Medal. 5. The applicant provides a photocopy of a certificate showing the award of the Army Achievement Medal (2nd Award) for the period 10 July 1994 to 15 May 1997 as announced by PO Number 147-06, issued by Headquarters, 95th MP Battalion. He was assigned to the 529th MP Company. 6. Department of the Army General Order Number 25, dated 2001, awarded the 529th MP Company the Army Superior Unit Award for the period 15 October 1995 to 10 December 1996. DISCUSSION AND CONCLUSIONS: 1. PO awarded the applicant the Army Achievement Medal (2nd Award) and the Driver and Mechanic Badge with Driver-W (Wheeled-Vehicle). These awards are not reflected on his DD Form 214. 2. The 529th MP Company was awarded the Army Superior Unit Award for a period coinciding with his assignment to the unit. His DD Form 214 also does not show this award.
