THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his secondary (S) military occupational specialty (MOS) of 19E "Tanker" correctly known as an Armor Crewman. 2. He states 19E was his first MOS and he served in that MOS for 3 years. 3. He provides his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) on 17 April 1978. On 28 April 1978, he attended basic armor training at Fort Knox, KY. 3. His record is void of orders or a certificate awarding him a primary (P) MOS or SMOS. However, his DA Form 2-1 (Personnel Qualification Record) shows in: a. Item 6 (MOS) on 18 August 1978, he was awarded 19G (Armor Reconnaissance Vehicle Crewman) as his PMOS. On 1 September 1981, he was subsequently awarded 19E as his PMOS. b. Item 17 (Civilian Education and Military Schools) he attended the Finance Specialist Course for 6 weeks in 1982. c. Item 35 (Record of Assignments) he was attached to the 15th Finance Company, Fort Benning, GA, as a 73C on 10 February 1982. He was reassigned to Germany as a 73C on 10 August 1982. 4. The applicant's DA Form 3340 (Request For RA Reenlistment or Extension), dated 11 December 1984; Orders 129-31, dated 24 May 1985; and Enlisted Evaluation Report for the period June 1985 through October 1985 show his PMOS as 73C and SMOS as 19E. 5. The applicant was discharged on 24 June 1991. He was credited with 13 years, 2 months, and 8 days of active duty service. His DD Form 214 shows in item 11 (Primary Specialty) "73C10 Finance Specialist – 9 years – 5 months." 6. Army Regulation 611-201 (Enlisted MOS Structure) shows that MOS 19G was converted to MOS 19E between March 1981 and March 1982. 7. Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. The regulation stated that the DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. The regulation requires the preparer to enter in item 11, from the Enlisted Record Brief the titles of all MOSs served for at least 1 year and include for each MOS the number of years and months served. For time determination, 16 days or more count as a month. Do not count basic training and advanced individual training. DISCUSSION AND CONCLUSIONS: 1. Although the exact days the applicant served in MOS 19E are unknown, the records show he was assigned MOS 19G as his PMOS on or about 18 August 1978 and this MOS was later converted to 19E. The evidence of record also shows he attended 73C course on or about 10 February 1982 and he was reassigned to Germany on 10 August 1982 as a 73C. 2. It appears he held 19E as his PMOS for a minimum of 3 years between 18 August 1978 and 10 February 1982 (approximately 3 years and 6 months). Therefore, in the interest of equity, it appears it would be appropriate to correct his records to show he served in MOS 19E for 3 years and 6 months.
