THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the amount of separation pay he received in item 18 (Remarks) of his DD Form 214 (Certificate of Release or Discharge from Active Duty). 2. The applicant states item 18 of his DD Form 214 shows he received separation pay in the amount of $43,065.12. He only received $11,843.10. 3. The applicant provides copies of his Defense Finance and Accounting Service (DFAS) Military Leave and Earnings Statement (LES) and DD Form 214. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army (RA) on 7 March 1995. He reenlisted in the RA on 23 July 1998, 5 June 2002, and 12 April 2006. At the time his April 2006 reenlistment, he was authorized a Selected Reenlistment Bonus. 2. On 20 March 2012, the applicant's commander initiated action to separate the applicant under the provisions of Army Regulation 635-200 (Personnel Separations – Active Duty Enlisted Administrative Separations), chapter 5-8, for Parenthood. 3. On 30 March 2012, the separation authority approved the applicant's discharge. 4. He provided a copy of his LES for the period from 1 through 20 July 2012 showing he received: * a deduction of enlistment bonus in the amount of $20,783.33 * separation pay in the amount of $11,463.54 * total entitlements in the amount of $47,470.10 * total deductions in the amount of $35,627.00 * a net amount of $11,843.10 * payment due at separation in the amount of $1,076.82 5. He was honorably discharged on 20 July 2012. He was credited with completing 16 years, 4 months, and 14 days of net active service this period. 6. Item 18 of his DD Form 214 contains the entries "Separation Pay $43,065.12" and "Member Is Entitled to Half Involuntary Separation Pay." 7. On 12 June 2015, a staff member of the Systems Liaison and Procedures Division, Policy and Procedures Branch, verified the applicant received $43,065.12 gross for half involuntary separation pay. The applicant also incurred a debt for his Career Status Bonus due to his early discharge that incurred a $20,783.33 collection. For that reason the amount of his separation pay was only $11,463.54. The amount of his final pay due was $1,076.82. 8. This information was provided to the applicant on 4 September 2015 for acknowledgement/rebuttal. He did not respond. 9. Army Regulation 635-5 (Separation Documents), in effect, at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active duty. The regulation stated item 18 would list for a Soldier receiving separation pay (as indicated by the finance office) the type of pay and amount. There was no provisions for listing the gross and net (after deductions) amounts of separation pay a Soldier received. 10. Army Regulation 635-8 (Separation Processing and Documents), current version states for Soldiers receiving separation, readjustment, or severance pay, the type of payment and gross amount of separation, readjustment, or severance pay will be entered on the DD Form 214. DISCUSSION AND CONCLUSIONS: 1. Notwithstanding the applicant's contention that he received $11,843.10, the evidence verified at the time of separation he received gross half separation pay in the amount of $43,065.12. This amount is properly listed in item 18 of his DD Form 214. 2. A debt collection for a reenlistment bonus resulted in him receiving net separation pay in the amount of $11,463.54 instead of the $43,065.12 as listed on his DD Form 214. In accordance with regulations, item 18 of the DD Form 214 would list the type and amount of separation pay received. The current version of the regulation states the DD Form 214 would list the type of payment and gross amount of the payment. His gross separation pay was clearly $43,065.12.
