THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number as XX1-XX-XXXX vice XX7-XX-XXXX. 2. The applicant states his SSN is incorrect on his DD Form 214. The third digit of his SSN is 1 and not 7. It was just a typographical error that was made at the time he was discharged. 3. The applicant provides his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve (USAR) on 16 October 1962. His DD Form 4 (Enlistment Record - Armed Forces of the United States), dated 16 October 1962, shows his SSN with the third digit as 1. He was honorably discharged from the USAR on 17 December 1963. 3. His record contains his DA Form 24 (Service Record) covering the period 16 October 1962 through 17 December 1963 wherein it shows his SSN with the third digit as 1. 4. He enlisted in the Regular Army (RA) on 18 December 1963. His DD Form 4, dated 18 December 1963, shows only his serial number (SN) and USAR SN and not his SSN. 5. His DA Form 20 (Enlisted Qualification Record) created upon his entry on active duty shows only his SN and not his SSN. 6. His record contains several personnel, medical, and legal documents that only show his SN and not his SSN. 7. He was honorably released from active duty on 29 November 1966 and he was transferred to the USAR Control Group. Item 32 (Remarks) of the DD Form 214 he was issued shows his SSN with the third digit as 7. 8. Letter Orders Number 09-1063237, dated 30 September 1970, issued by the U.S. Army Administration Center, St. Louis, MO, honorably released him from the USAR effective 15 October 1970. These orders show his SSN with the third digit as 1. 9. The applicant provides his social security card wherein it shows his SSN with the third digit as 1. DISCUSSION AND CONCLUSIONS: The evidence of record confirms the applicant's SSN was listed with the third digit as 1 when he enlisted in the USAR. This is the SSN that is shown on his DA Form 24. It appears an error occurred during the preparation of his DD Form 214 and his SSN was inadvertently entered with the third digit as 7.
