THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests the correction of item 12a (Date Entered Active Duty (AD) This Period) of her DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 27 September 1996 to show in the entry 9 July 1991 vice 28 September 1993. 2. The applicant states her original entry date of service was 9 July 1991 and not 28 September 1993. She had split active duty time in the U.S. Army Reserve (USAR), then she went into the active Army, and then the Individual Ready Reserve (IRR). 3. The applicant provides two DD Forms 214 and an Honorable Discharge Certificate. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant’s DD Form 4 (Enlistment/Reenlistment Document - Armed Forces of the United States), dated 13 June 1991, shows she enlisted in the USAR on that date for a period of 8 years. She was assigned to the 349th General Hospital, Los Angeles, CA. 3. Her record contains a DD Form 220 (Active Duty Report), dated 6 September 1991, wherein it shows she entered initial active duty for training (IADT) on 9 July 1991 and was released from IADT on 6 September 1991. 4. She entered ADT on 7 April 1992; she attended and successfully completed the military occupational specialty (MOS) 92B (Medical Laboratory Specialist) course and was awarded MOS 92B. She was released from ADT on 5 August 1992 to the control of her USAR unit. She was discharged from the USAR on 27 September 1983 for the purpose of enlisting in the Regular Army (RA). 5. Her record contains a DD Form 4, dated 28 September 1993, wherein it shows she enlisted in the RA on that date for a period of 3 years. 6. On 12 August 1996, she enlisted in the Oklahoma Army National Guard effective upon her release from active duty. 7. She was honorably released from active duty on 27 September 1996 and she was transferred to the OKARNG. Item 12b of the DD Form 214 she was issued for this period of service shows the entry 28 September 1993. 8. Army Regulation 635-5 (Separation Documents) at the time established the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is prepared for all personnel at the time of their retirement, discharge, or release from active duty. The DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge (emphasis added). DISCUSSION AND CONCLUSIONS: The DD Form 214 reflects a Soldier’s most recent period of continuous active duty service. The evidence of record confirms the applicant enlisted in the RA and entered active duty as a member of the RA on 28 September 1993; this is correctly shown in item 12a of her DD Form 214 for the period ending 27 September 1996. There is no error or injustice.
