As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to his 25 October 1968 DD Form 214 in: a. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show service in Vietnam in February and March 1967 and completion of a training course there. 2. The applicant states there doesn’t seem to be any record of these facts on his DD Form 214. 3. The applicant provides copies of his travel orders to Saigon for temporary duty (TDY) and a training certificate. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army and entered active duty on 25 October 1965. He completed training as a fixed station communication repairman. 3. He served in Thailand from 19 October 1966 to 10 October 1967 with 55th Signal Company (Support). 4. His DA Form 20 (Enlisted Qualification Record) shows in item 31 (Foreign Service) – USARPAC-Thailand 12 Months. 5. The applicant returned to the United States and was assigned to Fort Huachuca, Arizona. He was honorably released from active duty on 24 October 1968 and transferred to the U.S. Army Reserve in pay grade E-5. 6. His DD Form 214 shows: a. In item 22c (Foreign or Sea Service), “USARPAC 1 0 0 “ (U.S. Army Pacific for 1 year, 0 months, and 0 days). b. In item 25 (Education and Training Completed) - MILITARY EDUCATION: Fxd Sta Rec Rpmn 32B2O 21wks 66 Fxd Sta Tech Con 32D2O 10wks 66 7. In support of his request the applicant provides copies of his travel orders to depart on 25 February 1967 for travel to Saigon for approximately 25 days temporary duty (TDY). The training certificate shows completion of a 181 hour Toll Test Facilities Controller Course at the 1st Signal Brigade School, Saigon, Vietnam between 1 March and 21 March 1967. 8. There is no documentation to show the exact travel schedule. REFERENCES: Army Regulation 635-5 (Separations Documents), then in effect, forth the policy and procedures for completing the DD Form 214. The direction for the remarks block stated, “Indicate Indochina and Korea service on or after 5 August 1964 by entering inclusive dates of service in Vietnam and indicating ‘yes’ of ‘no’ for service in Indochina and Korea, Where the record reflects assignment to an organization in Burma, Laos, Thailand, Cambodia or Vietnam show ‘yes’ for Indochina.” . DISCUSSION: 1. The applicant attended a course in Vietnam between 1 March and 21 March 1967. The Education and Training Completed item of his DD Form 214 should contain an entry showing, “Toll Test Facilities Controller 3wks 67.” 2. He served in Thailand and TDY in Vietnam. The exact dates of his arrival and departure are unknown; he was directed to depart Thailand on 25 February. Since a day can’t be counted twice, his stay in Vietnam appears to have been from 26 February through 22 March 1967.
