Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: * his civilian education level as 2 years of college and that he completed certification in Computer Aided Drafting and Design (CADD) * completion of the Structured Self Development (SSD) Level 3 course 2. The applicant states his military record has not been updated. 3. He also states that he is employed as a Construction Inspector, GS-11. 4. The applicant did not provide any additional supporting evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant is a U. S. Army Reserve (USAR) sergeant first class/E-7. 3. He served in an active duty status from 14 February 2002 to 13 February 2006 and from 25 January 2010 to 23 January 2013. a. The DD Form 214 that he was issued on 13 February 2006 shows in item 14 (Military Education) the Food Service Operation Course, 8 weeks, September 2002. b. The DD Form 214 that he was issued on 23 January 2013 shows “None” in item 14. 4. His record contains: * a certificate from Montgomery Community College, MA, showing on 19 May 2000, he completed the Computer Aided Drafting course. * a Department of the Army Certificate of Training, dated 23 December 2014, showing he completed Structured Self-Development – Level 3 REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The DD Form 214 is a summary of a Soldier's most recent period of continuous active service. Block 14: Military Education states list all formal, in-service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours duration. DISCUSSION: 1. There are no provisions for entering on a DD Form 214 civilian or military education that was completed outside the period covered by the DD Form 214. 2. The certificates that are available show he completed: * Computer Aided Drafting course on 19 May 2000, prior to entering the military * Structured Self-Development – Level 3 on 23 December 2014; after he was REFRAD on 23 January 2013 * These courses cannot be added to his DD Forms 214, because they were civilian courses that were completed prior to or after his DD Forms 214 were issued 3. There are no errors in the education listed on his DD Forms 214. 4.
