Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "X5X-7X-XXXX" instead of "X8X-4X-XXXX." 2. The applicant states, in effect, his SSN appears as "X8X-4X-XXXX" on his DD Form 214; however, it should be shown as "X5X-7X-XXXX." 3. The applicant provides copies of his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 22 June 1967. His DD Form 47 (Record of Induction) does not list his SSN, only his service number. 3. A review of the documents contained in his available military personnel records, many of which bear his signature, show he was identified primarily by his service number while serving on active duty. 4. He was honorably released from active duty on 24 January 1969 and transferred to the U.S. Army Reserve. Item 3 (SSN) of the DD Form 214 issued to the applicant at the time of his separation shows his SSN as "X8X-4X-XXXX." 5. A USAAC Form 172 (Option to Extend Ready Reserve Obligation), dated December 1971, shows his SSN as "X5X-7X-XXXX." 6. Letter Orders Number 05-1117120, issued by the Office of the Adjutant General, U.S. Army Reserve Components Personnel and Administrative Center on 22 May 1973, honorably discharged him. The orders show his SSN as "X5X-7X-XXXX." 7. The National Personnel Records Center, where his service records have been filed since his discharge, has filed his records under SSN "X5X-7X-XXXX." 8. He provides a social security card issued by the Social Security Administration that shows his SSN as "X5X-7X-XXXX." REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide an individual with documentary evidence of his or her military service. It is important that information entered on the form is complete and accurate. DISCUSSION: 1. The applicant's request for correction of his DD Form 214 to show his SSN as "X5X-7X-XXXX" instead of "X8X-4X-XXXX" was carefully considered. 2. The applicant was identified principally throughout his period of active military service by his Army service number. It appears he took measures to correct the SSN in his record shortly after his release from active duty. While his DD Form 214 reflects the SSN that was used exclusively during his active duty service, the evidence shows that SSN was, in fact, incorrect. It is probable that, because the service number was the primary means of identification used through most of his active duty service, the error in his SSN was inconsequential until he was serving in the U.S. Army Reserve.
