Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: * award of the Army Achievement Medal * 6 months of active service during the period 20 June 1983 to 26 January 1984 * award of military occupational specialty (MOS) 76V (Material Storage and Handling Specialist), MOS 71L (Administrative Specialist), and MOS 75B (Personnel Administrative Specialist) 2. The applicant states: * she lost all of her records in a flood in 1996, except the documents with her application * her DD Form 214 for the period ending 2 December 1981 needs updating 3. The applicant provides: * a self-authored statement * DD Form 214 for the period ending 2 December 1981 * Headquarters, First U.S. Army, Permanent Orders 31-2, dated 12 April 1984 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the U.S. Army Reserve on 8 June 1981. 3. On 2 September 1981, she was ordered to active duty for training. 4. On 12 December 1981, she was honorably released from active duty. Her DD Form 214 for this period shows in: * item 11 (Primary Specialty Number, Title, and Years) – MOS 76V * item12c (Net Active Service this Period) – 3 months and 1 day * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – Army Service Ribbon 5. On 3 October 1983, she was ordered to active duty for training for a period of 179 days. 6. Headquarters, First U.S. Army, Permanent Orders 31-2, dated 12 April 1984, awarded her the Army Achievement Medal for the period 3 October 1983 to 29 March 1984. 7. On 29 March 1984, she was honorably released from active duty. Her DD Form 214 for this period shows in: * item 11 – * MOS 71L – 2 years and 3 months * MOS 75B – 3 months * item 12c – 5 months and 27 days * item 13 – Army Service Ribbon 8. On 2 May 1989, she was honorably discharged from the U.S. Army Reserve. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, governed preparation of the DD Form 214. A DD Form 214 would be issued to all personnel at the time of retirement, discharge, or release from the Active Army. DISCUSSION: 1. The applicant states a flood destroyed copies of the records she possessed. It appears she does not have a copy of her DD Form 214 for the period ending 29 March 1984. A copy of this DD Form 214 will be provided to the applicant with this Record of Proceedings. 2. Her DD Form 214 for the period ending 29 March 1984 properly shows the the period of service for which she was ordered to active duty and the two MOS's (71L and 76V) she was awarded. 3. Permanent orders awarded her the Army Achievement Medal for the period 3 October 1983 to 29 March 1984.
