THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of the social security number (SSN) listed on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states his SSN is incorrect on nearly all of his military records. Most of his records show , but it should read . It causes too much confusion, questions, and errors. 3. The applicant provides: * three Standard Forms 46 (U.S. Government Motor Vehicle Operator's Identification Card) issued on 25 February 1966, 1 June 1966, and 22 November 1966 * DD Form 214 * Social security card * VA Form 21-0845 (Authorization to Disclose Personal Information to a Third Party), dated 20 April 2015 * VA Form 21-4138 (Statement in Support of Claim), dated 6 August 2015 * VA Form 21-22 (Appointment of Veterans Service Organization as Claimant's Representative), dated 12 August 2015 * Letter from the Americal Legion, Department of Indiana Service Department, dated 12 August 2015 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 22 April 1964. At that time, a military service number was issued for the purpose of identification. He later completed a DD Form 398 (Statement of Personal History) that shows his SSN as . 3. He provided Standard Forms 46 issued on 1 June 1966 and 22 November 1966 that both show his SSN as . 4. The Army released him from active duty on 21 April 1967. His DD Form 214 shows his SSN as . 5. He provided his social security card that shows his SSN as . REFERENCES: Army Regulation 635-5 (Separation Documents), dated 23 January 1967, governed the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. The regulation states to transcribe the Soldier?s Social Security account number from DA Form 2139 (Military Pay Voucher) and enter it in item 3 (SSN) of the DD Form 214. DISCUSSION: 1. The applicant entered active service on 22 April 1964. At that time, a military service number was issued for the purpose of identification. However, his DD Form 4 and DD Form 398 both indicate his SSN as . 2. The social security card and U.S. Government Motor Vehicle Operator's Identification Cards he provided show his SSN as . 3. It is logical to conclude an administrative error occurred during the preparation of his DD Form 214. //NOTHING FOLLOWS//
