The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by adding to item 30 (Remarks) of the applicant's DD Form 214 the entry "Secondary MOS, 71B2O CLERK TYPIST." 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 23a (Specialty Number and Title) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show military occupational specialty (MOS) 71B (Clerk Typist) instead of MOS 94B (Cook). 2. The applicant states he never finished cook school. He became a clerk typist while in school. He went to Vietnam and was assigned as a clerk typist with the 506th Supply and Service Company. 3. The applicant provides his DD Form 214 and separation orders. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 24 October 1967. He completed basic combat training at Fort Bragg, NC. 3. He was reassigned to Company C, 14th Battalion, 4th Brigade, Fort Jackson, SC on or about 4 March 1968 for advanced individual training (AIT) in MOS 94B. 4. His DA Form 20 (Enlisted Qualification Record) shows in: * Item 27 (Military Education), he completed the 8-week Food Service Course in 1968 * Item 22 (MOS), 94B effective 26 April 1968; however, there is a line drawn through this MOS and below appears the entry "[Primary (P)] MOS 71B2O, Clerk Typist, 3 [November 1968]" 5. On 4 May 1968, the U.S. Army Training Center, Fort Jackson, published Special Orders Number 109 reassigning the applicant to Vietnam in MOS 94B. 6. He served in Vietnam from on or about 6 June 1968 to 5 June 1969. His DA Form 20 shows in item 38 (Record of Assignments) that he was assigned to: * 483rd Field Service Company, in MOS 94B, from 9 June to 19 June 1968 * 506th Supply and Service Battalion, in MOS 94B, from 20 June 1968 to 2 June 1969 7. On 10 June 1968, Headquarters, 266th Supply and Service Battalion, published Special Orders Number 143 reassigning him from the 483rd Field Service Company to the 506th Supply and Service Company in MOS 94B. 8. On 26 June 1968, Headquarters, 506th Supply and Service Company, published Special Orders Number 57 promoting him to E-3 in MOS 94B. 9. On 3 November 1968, Headquarters, 506th Supply and Service Company published Special Orders Number 94 promoting him to E-4 in MOS 71B. 10. On 11 December 1968, Headquarters, 506th Supply and Service Company published Special Orders Number 101 appointing him as the unit mail clerk effective 11 December 1968. 11. On 5 June 1969, Headquarters, U.S. Army Personnel Center, Oakland, CA, published Special Orders Number 156 separating him from active duty effective 5 June 1969. These orders listed his MOS as 71B. 12. He was honorably released from active duty on 5 June 1969. Item 23a of his DD Form 214 shows the entry "94B2O Cook." REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the Soldier with documentary evidence of his/her military service. It is important that information entered on the form should be complete and accurate. The DD Form 214 is a summary of a Soldier's most recent period of continuous active duty. Item 23a was to show the Soldier's primary MOS and title. DISCUSSION AND CONCLUSIONS: 1. The available evidence shows the applicant was trained in MOS 94B at Fort Jackson. He was transferred to Vietnam in MOS 94B and was assigned to the 506th Supply and Service Company in that MOS. It appears that in November 1968 his unit began utilizing him in MOS 71B and he was appointed as the unit mail clerk. There are no orders available awarding him primary MOS 71B. 2. The MOS shown in item 23a of his DD Form 214 appears to be correct. However, he was promoted to pay grade E-4 in MOS 71B and his discharge orders show he was released and transferred to the United States Army Reserve Control Group in this MOS. 3. Although the governing policy at the time only required entry of the primary MOS on the DD Form 214, it appears that, in this case, the primary MOS does not accurately represent the duties the applicant actually performed.
