Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), for the period ending 8 December 1967, to show his social security number (SSN) as "XXX-XX-X6XX" instead of "XXX-XX-X7XX." 2. The applicant states his SSN is incorrectly shown on his DD Form 214. 3. The applicant provides a self-authored statement and the following documents: * DD Form 214 * certificate of live birth * social security card * DD Form 47 (Record of Induction), dated 12 May 1965 * Special Orders Number 19, issued by Armed Forces Examining and Entrance Station, Montgomery, Alabama, on 27 January 1966 * two U.S. Army Reserve (USAR) discharge orders, dated 12 January 1972 and 27 February 1973 * two letters from the Social Security Administration, dated 3 May 2004 and 24 September 2007 * three letters from the National Personnel Records Center (NPRC), dated 4 August 2005, 2 November 2005, and 3 August 2015 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant's complete military records are not available for review. A complete and thorough search for his military records was conducted; however, his records could not be located. This case is being considered based on the documents provided by the applicant. 3. The applicant was inducted into the Army of the United States on 27 January 1966. His DD Form 47 does not list his SSN, only his service number. 4. The applicant was honorably released from active duty and transferred to the USAR Control Group (Annual Training) on 8 December 1967. Item 3 (SSN) of his DD Form 214 shows his SSN as "XXX-XX-X7XX." 5. The applicant provides: a. Letter Orders Number 02-1045383, issued by the USAR Components Personnel and Administration Center, St. Louis, Missouri, on 27 February 1973, which show that at the time of his discharge from the Standby Reserve, his SSN was listed as "XXX-XX-X6XX." b. A copy of his social security card, which shows his SSN as "XXX-XX-X6XX." REFERENCES: Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION: 1. The evidence of record includes a document that shows the applicant was identified by SSN "XXX-XX-X6XX" during his period of military service. This constitutes evidence that he served under the SSN he claims is correct. 2.
