Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his military records to show he completed high school. 2. The applicant states, in effect, his high school diploma is not filed in his record maintained on the Interactive Personnel Electronic Records Management System (iPERMS). He would like to add it to his record. He also says that his high school diploma was attached to his copy of his military contract. 3. The applicant provides: * High School Diploma * Annex E to DD Form 4, Enlistment Bonus Addendum, Army National Guard (ARNG) of the United States (US) CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Army National Guard (ARNG) on 27 August 2004. Item 12 (Education – Years/Highest Education Grade Completed) of his DD Form 1966/1 (Record of Military Processing) shows "12/L." 3. He entered active duty for training (ADT) on 11 January 2005. He completed training and he was awarded military occupational specialty 31B (Military Police). 4. He was honorably released from ADT on 27 May 2005. He was transferred back to his ARNG unit. His DD Form 214 (Certificate of Release or Discharge from Active Duty) shows in item 15b (High School Graduate or Equivalent) an "X" in the "Yes" block, indicating he was a high school graduate at the time of separation. 5. He was ordered to active duty in support of Operation Iraqi/Enduring Freedom on 31 March 2007. He was honorably released from active duty on 5 June 2008. His DD Form 214 shows in item 15b (High School Graduate or Equivalent) an "X" in the "Yes" block, indicating he was a high school graduate at the time of separation. 6. He provides a diploma that confirms he completed high school in June 2004. 7. A thorough review of the applicant’s record maintained on iPERMS was conducted. This review revealed that his high school diploma was not filed/uploaded in his iPERMS record. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. Item 15b shows that an "X" is used in the appropriate block to determine if a Soldier is a high school graduate or equivalent. This information should be taken from the Soldier's records. 2. Army Regulation 600-8-104 (Army Military Human Resource Record Management) governs the composition of the official military personnel file (OMPF) and states the state/territory folder contains documents referencing state awards and personnel actions. The service folder contains general, administrative, and service documents and data. Appendix B-1 refers to the Army Human Resources Command, Records Branch website, which shows a high school diploma is to be filed in the service or state/territory folder of the OMPF. DISCUSSION: The evidence of the record shows the applicant completed high school prior to enlisting in the ARNG. In addition, the applicant provided a copy of his diploma confirming completion of high school in June 2004.
