Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his record to show the time he served with a U.S. Army Reserve (USAR) unit from 1984 to 1987 and to show any awards that were to be presented to him at that time. 2. The applicant states his record does not reflect his time in the USAR nor does it show any awards that were to be presented to him during that time. 3. The applicant provides: * self-authored letter, dated 15 September 2015 * Headquarters, 123rd USAR Command Orders 57-10, dated 25 August 1985 * The Army Institute for Professional Development Diploma, dated 5 February 1985 * The Army Institute for Professional Development Diploma, dated 10 December 1985 * Basic Course for Reserve Component Noncommissioned Officers Diploma, dated 21 September 1985 * U.S. Army Reserve Personnel Center Orders D-05-037433, dated 27 May 1987 * Honorable Discharge Certificate, dated 29 May 1987 * 199th Supply Company Letter of Appreciation, dated 1 August 1985 * Support Group, 123d USAR Command Letter of Commendation, dated 12 December 1985 * Headquarters, 300th Supply and Support Battalion memorandum, dated 8 January 1986. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army (RA) for 3 years on 28 February 1964. He completed training as an administrative assistant. 3. After completing 3 years of total active service, the applicant was released from active duty (REFRAD) on 27 February 1967. He was transferred to the USAR Control Group (Reinforcement). 4. His DD Form 214 shows he was awarded the National Defense Service Medal and the Good Conduct Medal. 5. The applicant was discharged from the USAR Control Group on 27 February 1970. 6. He reenlisted in the USAR for 3 years on 30 May 1984. He was assigned to the 199th Supply Company, Grissom Air Force Base, Indiana. After completing 3 years of service this period he was honorably discharged from the USAR on 29 May 1987. 7. His DA Form 2-1 (Personnel Qualification Record) shows in: * Item 6 (Military Occupational Specialties (MOS)), he held – * primary MOS 76Y10 (Materiel Storage and Handling Specialist), effective 5 February 1985 * secondary MOS 71L10 (Administrative Specialist), effective 19 July 1964 * item 9 (Awards, Decorations, and Campaigns), he was awarded the Army Commendation Medal, Good Conduct Medal, Overseas Service Ribbon, National Defense Service Ribbon, and Army Service Ribbon * item 17 (Civilian Education and Military Schools), his military and civilian education * item 35 (Record of Assignments), his service history, to include his USAR assignments 7. The applicant provides letters of commendation, a letter of appreciation, discharge orders, military occupational specialty orders, and course diplomas, all of which are dated after his REFRAD on 27 February 1967. These documents are also filed in his Official Military Personnel File. REFERENCES: Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. The regulation stated that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provides a brief, clear-cut record of active Army service at the time of REFRAD, retirement, or discharge. This regulation further stated that certificates of achievement, letters of commendation, and similar documents are not recorded on the DD Form 214. A similar document is not issued to members of the USAR upon discharge. DISCUSSION: 1. The issues the applicant raises all pertain to his service in the USAR from 1984 to 1987. Reserve service and accomplishments are not summarized on a DD Form 214 or any similar form. However, his DA Form 2-1 does provide a summary of his USAR service, his military education, and his awards. 2. Although he states otherwise, the documents he provided with his application are filed in his Official Military Personnel File.
