Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to add award of military occupational specialty (MOS) 11B (Light Weapons Infantryman). 2. The applicant states: a.  He attended infantry advanced individual training at Fort Dix, NJ, from June through August 1967 and he graduated in MOS 11B. b.  He was awarded the Combat Infantryman Badge for his service in Vietnam. 3. The applicant provides a copy of Headquarters, The Student Brigade, U.S. Army Infantry School, Special Orders Number 242, dated 4 October 1967. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 24 April 1967. 3. U.S. Army Training Center, Infantry, Special Orders Number 220, dated 8 August 1967, awarded him primary MOS 11B effective on or about 25 August 1967 under the provisions of Army Regulation 600-200 (Enlisted Personnel Management System), section V, paragraph 2-20b(3). 4. Headquarters, The Student Brigade, U.S. Army Infantry School, Special Orders Number 242, dated 4 October 1967, awarded him special qualification identifier P (Parachutist) and authorized award of the Parachutist Badge effective 6 October 1967. 5. Headquarters, U.S. Army Support Command, Cam Rahn Bay, Special Orders Number 276, dated 2 October 1968, awarded him primary MOS 43E3P (Parachute Rigger – Parachutist) and withdrew primary MOS 43E2P and secondary MOS 11B2P effective 25 September 1968. 6. His DA Form 20 (Enlisted Qualification Record) shows in: * item 22 (MOSs) – * primary MOS 11B effective 25 August 1967 * primary MOS 43E effective 25 September 1968 * item 27 (Military Education) – Parachute Rigger, MOS 43E2P, Quartermaster School, 12 weeks, 1968 7. His records are void of any evidence showing he was awarded the Combat Infantryman Badge or he held MOS 11B as his primary MOS after 25 September 1968. 8. On 23 April 1970, he was honorably released from active duty. Item 23a (Specialty Number and Title) of his DD Form 214 shows MOS 43E3P. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for preparing and distributing the DD Form 214. The instructions for item 23a stated to enter the primary MOS code number and title. If not applicable, enter "NA." 2. Army Regulation 600-200, in effect at the time, prescribed policies and procedures for the career management of Army enlisted personnel. Section V, paragraph 2-20b(3), stated a new MOS would be awarded upon successful completion of MOS training at a U.S. Army service school or a training activity, including U.S. Air Force, Navy, or Marine Corps school authorized to train Amy personnel. DISCUSSION: 1. The evidence of record shows he was awarded primary MOS 11B effective 25 August 1967. He then completed MOS 43E training and he was awarded primary MOS 43E2P effective 25 September 1968. His records show he maintained MOS 43E throughout the remainder of his service. 2.
