The Board determined that the evidence presented was sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 30 of his DD Form 214 by adding the social security number listed on his DD Form 398. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his SSN as 016-XX-XXXX instead of 901-XX-XXXX. 2. The applicant states he recently discovered his SSN was incorrect when filing for Department of Veteran Affairs (VA) Benefits. 3. The applicant provides copies of his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 6 November 1970, the applicant enlisted in the Regular Army for a period of 3 years. The DD Form 4 (Enlistment Contract - Armed Forces of the United States) prepared during his enlistment processing lists his SSN as 901-XX-XXXX. 3. The applicant's military record contains a DD Form 398 (Statement of Personal History) dated 6 November 1970, that was completed during his enlistment processing. Item 13 (Employment) contains a block for the SSN wherein he entered his SSN as "016-XX-XXXX." 4. The DA Form 20 (Enlisted Qualification Record) prepared upon his entry on active duty also lists his SSN as 016-XX-XXXX. The applicant's Official Military Personnel File (OMPF) contains documents that were prepared throughout his military service that list his SSN as either "016-XX-XXXX" or “901-XX-XXXX." 5. On 12 May 1972, the applicant was discharged from active duty, having completed 1 year, 4 months, and 10 days of total active military service. The DD Form 214 he was issued at the time lists his SSN as"901-XX-XXXX." 6. The applicant provides a copy of his social security card that lists his SSN as “016-XX-XXXX.” REFERENCES: Army Regulation 600-2 (Name and Birth Data, Social Security Account Number (SSAN), and Temporary Identification Number (TIN)), effective 1 July 1969, announced the use of the SSN in lieu of military service numbers. A TIN would be issued during the pre-enlistment processing for entrance in the active Army to those individuals who did not have an SSN. The TIN was a 9-digit number that always began with the number "9." Upon receipt of an SSN, the TIN entry on all records would be lined out and the SSN would be entered. DISCUSSION: 1. Many Soldiers did not have an SSN when they initially enlisted or were inducted into the Regular Army or Army of the United States; thus, they were issued a TIN. Soldiers in this category would have been required to apply for a social security card at the time of induction/enlistment. 2. Apparently the applicant received his social security card while in an active duty status because his OMPF contains documents that lists the SSN that is listed on his social security card; however, other documents in his OMPF contain the TIN. 3. The applicant’s DD Form 398 is among those documents listing the SSN that is shown on his social security card. 4. For historical purposes, the Army has an interest in maintaining the integrity of its records. The data and information contained in those records should reflect the conditions and circumstances that existed at the time the records were created. 5. The TIN is currently listed in item 3 of his DD Form 214; however, the SSN is not listed on his DD Form 214. The Board may recommend adding an entry in item 30 (Remarks) of his DD Form 214 to show his SSN as it is listed on his DD Form 398.
