Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Combat Action Badge. 2. The applicant states during his service in Pleiku, Vietnam; he took part in over 100 firing missions. There was one incident that took place on 11 May 1969, when he was attacked by enemy forces. He received the Purple Heart for wounds incurred during this attack. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 8 October 1968. He was awarded military occupational specialty 13A (Field Artillery Basic). 3. He served in Vietnam from 13 March 1969 through 15 May 1970 and he participated in four campaigns. He was assigned to Battery D, 5th Battalion, 16th Artillery, 4th Infantry Division. 4. On 15 May 1970 he was honorably discharged and transferred to the U.S. Army Reserve. 5. Item 24 (Decorations, Medals, Badges, Commendations, Citations and Campaign Ribbons Awarded or Authorized) of his DD Form 214 shows among his awards the Purple Heart. It does not show award of the Combat Action Badge. REFERENCES: Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The requirements for award of the Combat Action Badge are branch and military occupational specialty immaterial. Assignment to a combat arms unit or a unit organized to conduct close or offensive combat operations, or performing offensive combat operations, is not required to qualify for the Combat Action Badge. Retroactive awards of this badge are not authorized for service prior to 18 September 2001. DISCUSSION: Retroactive awards of the Combat Action Badge are not authorized prior to 18 September 2001.
