Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show the Meritorious Unit Commendation. 2. The applicant states that on the night of 26 January 1968 Camp Holloway, Pleiku, Vietnam, came under both mortar and ground attack. The attack lasted over an hour and the 604th Transportation Company Detachment sustained significant damage. The 604th as well as other units of Camp Holloway were cited for the MUC. 3. The applicant provides a copy of a 52d Combat Aviation Battalion letter, subject: Enemy Attack on TTS Installations After Action Report, dated 31 January 1968. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted on 9 March 1966. He held military occupational specialty 67N (Helicopter Mechanic). 3. The applicant's DA Form 20 (Enlisted Qualification Record) shows in: a. Item 38 (Record of Assignments) – he was assigned in Vietnam to the 604th Transportation Detachment from 6 May 1967 to 26 February 1968. b. Item 41 (Awards and Decorations) – National Defense Service Medal, Vietnam Service Medal, and the Marksman Marksmanship Qualification Badge with Rifle Bar. 4. This is no indication he was assigned or attached to any other unit during his Vietnam service. 5. The applicant was honorably released from active duty on 28 February 1968 as a specialist four/E-4. He had completed 1 year, 11 months, and 20 days of total active service. 6. His DD Form 214 lists his awards as the National Defense Service Medal, Vietnam Service Medal, and the Marksman Marksmanship Qualification Badge with Rifle Bar. 7. He provides a 52d Aviation Battalion report of an enemy attack on Camp Holloway, Pleiku, Vietnam that began in the early morning of 26 January 1968. The attack involved enemy mortars and an estimated 50-60 man force of sappers. Units affected are listed as the 604th Transportation Maintenance Company and the 88th Supply and Service (S&S) Battalion. There were 45 U.S. casualties; 42 were treated at the Camp Holloway Dispensary and 3 were transported to the 71st Evacuation Hospital. The 604th Transportation Detachment is not mentioned in the report. REFERENCES: Department of the Army (DA) Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) is published to assist commanders and personnel officers in determining or establishing the eligibility of individual members for campaign participation credit, assault landing credit, and unit citation badges awarded during the Vietnam Conflict, the Grenada Operation, and the period of service subsequent to the Vietnam Conflict up to September 1987. This pamphlet does not show the 604th Transportation Detachment was cited for award of the Meritorious Unit Commendation. The unit was cited for award of the Republic of Vietnam Gallantry Cross with Palm Unit Citation for service from 27 March 1967-17 May 1968 by Department of the Army General Orders (DAGO) Number 21, dated 1969, as amended by DAGO Number 46, dated 1969. DISCUSSION: The applicant's records show he served with the 604th Transportation Detachment in Vietnam from 6 May 1967 to 26 February 1968. This unit was not cited for award of the Meritorious Unit Commendation.
