Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 28 December 1966 to show his social security account number (SSAN) as XXX-XX-6805. 2. The applicant states he realized the SSAN shown on his DD Form 214 was incorrect when he applied for Department of Veterans Affairs (VA) disability benefits. 3. The applicant provides: * cover letter from the Board of Chosen Freeholders, County of Burlington, NJ, dated 2 October 2015 * VA Form 21-4138 (Statement in Support of Claim), dated 30 September 2015 * U.S. Uniformed Services Identification Card, issued 9 November 2001 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 27 February 1964. 3. His available records do not contain copies of his original enlistment documents or DA Form 24 (Service Record). 4. He was honorably released from active duty effective 28 December 1966 and transferred to the U.S. Army Reserve to complete his military service obligation. 5. Item 32 (Remarks) of his DD Form 214 for the period ending 28 December 1966 shows his SSAN as XXX-XX-6305. 6. He subsequently served in both the U.S. Army Reserve and New Jersey Army National Guard until his transfer to the U.S. Army Reserve Retired Reserve on 4 October 1995. He completed over 20 qualifying years for retired pay purposes. 7. His records contain a DA Form 2-1 (Personnel Qualification Record – Part II), prepared on 24 October 1984 and reviewed on 4 October 1992, showing his SSAN as XXX-XX-6805. 8. His records contain a DA Form 2A (Personnel Qualification Record – Enlisted), prepared on 10 August 1995, showing his SSAN as XXX-XX-6805. 9. His military service records, with exception of his DD Form 214 for the period ending 28 December 1966, show his SSAN as XXX-XX-6805. 10. He provided a copy of his U.S. Uniformed Services Identification Card, issued 9 November 2001, showing his SSAN as XXX-XX-6805. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The instructions stated to transcribe the social security account number (SSAN) from the individual's DA Form 24 in the following manner: "SSAN 000-00-0000." DISCUSSION: 1. All of the applicant's available military service records, with exception of his DD Form 214 for the period ending 28 December 1966, show his SSAN as XXX-XX-6805. 2.
