The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by: a. adding to item 13 of his DD Form 214: * Army Achievement Medal (1st Oak Leaf Cluster) * Global War on Terrorism Service Medal * Sharpshooter Marksmanship Qualification Badge with Rifle Bar and Auto Rifle Bar * Marksman Marksmanship Qualification Badge with Machine Gun Bar b. deleting from item 18 of his DD Form 214 the entry "member has not completed first full term of service," replacing it with the entry "member has completed first full term of service." 2. The Board further determined that the evidence presented was insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show: a. He completed first full term of service. b. He was awarded or authorized the: * Global War on Terrorism Service Medal (GWOTSM) * Army Achievement Medal (2nd Award) * Combat Service Identification Badge (CSIB) * Overseas Service Bar * Sharpshooter Marksmanship Qualification Badge with Rifle Bar * First Class Marksmanship Qualification Badge with Rifle Bar * Marksman Marksmanship Qualification Badge with Machine Gun Bar 2. The applicant states: a. The statement in item 18 of his DD Form 214 is incorrect, in accordance with (IAW) Army Regulation (AR) 635-8 (Separation Processing and Documents), chapter 5-6, dated 10 February 2014. Routinely, a Regular Army Soldier should not be considered to have completed the first full term of service if separation occurs before the end of the initial contracted period of service. However, if a Soldier reenlists before the completion of that period of service, the first term of service is effectively redefined by virtue of the reenlistment contract. A prior service enlistee is considered to be on second term of military service, even if that Soldier fails to complete the current term of service. The appropriate entry is “HAS.” b. The entries listed in item 13 of his DD Form 214 are not in accordance with the guidance contained in AR 635-8. 3. The applicant provides copies of: * a self-authored continuation sheet * DA Forms 638 (Recommendation for Award) and DA Forms 4980-18 (Army Achievement Medal Certificate). * DD Form 214 * qualification scorecards * enlistment contract * assignment orders * enlistment record brief (ERB) CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the United States Army Reserve (USAR) Delayed Entry Program (DEP) on 17 January 2012. On 9 April 2012, he enlisted in the Regular Army (RA) for four years. 2. On 17 October 2012, a DA Form 4187 (Personnel Action) shows the applicant was assigned to 585th Engineer Company, JBLM, Lewis, WA. 3. The applicant's ERB shows he deployed to Afghanistan from 28 January 2013 to 23 October 2013 (9 months). 4. A DA Form 7304-R (Scorecard for M249 AR) dated 28 January 2015 shows the applicant qualified as a first class gunner (i.e., sharpshooter) with the M249 weapon system (a light machine gun for which an Auto Rifle Bar is authorized for wear with the applicable Marksmanship Qualification Badge). 5. A DA Form 7449-R (M2 Caliber .50 Heavy Barrel Machine Gun Firing Table II, Day Qualification Scorecard) dated 25 February 2015 shows the applicant qualified as a marksman with the M2 .50 caliber weapon system. 6. On 2 April 2015, the applicant’s request for reenlistment was approved. He reenlisted in the RA for two years on 13 April 2015. 7. On 23 April 2015, a DA Form 5790-R (Record Firing Scorecard), shows the applicant qualified as a sharpshooter with a M4 weapon system (a rifle). 8. On 12 May 2015, a DA Form 638 shows the applicant was awarded the Army Achievement Medal (2nd Award). 9. The applicant’s DD Form 214 shows he was discharged on 28 September 2015 under honorable conditions, for a pattern of misconduct. He completed 3 years, 5 months, and 20 days of net active service. This DD Form 214 shows in: a. Item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), he was awarded or authorized the: * Afghanistan Campaign Medal with Campaign Star * Army Achievement Medal * Army Good Conduct Medal * National Defense Service Medal * Army Service Ribbon * Overseas Service Ribbon * North Atlantic Treaty Organization (NATO) Medal b. Item 18 (Remarks), in pertinent part, the following entries: * continuous honorable active service 9 April 2012 – 12 April 2015 * immediate reenlistments this period 13 April 2015 – 28 September 2015 * served in a designated imminent danger pay area * service in Afghanistan 28 January 2013 – 23 October 2013 * member has not completed first full term of service REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) provides policy, criteria, and administrative instructions concerning military awards and decorations. The Global War on Terrorism Service Medal is authorized for award to members of the Armed Forces of the United States who have participated in GWOT operations outside of the area of eligibility (AOE) designated for award of the Global War on Terrorism Expeditionary Medal (GWOTEM), Afghanistan Campaign Medal, or Iraq Campaign Medal (ICM). All Soldiers on active duty, including Reserve Component Soldiers mobilized or National Guard Soldiers activated on or after 11 September 2001 to a date to be determined, having served 30 consecutive or 60 nonconsecutive days are authorized the GWOTSM. 2. Army Regulation 635-8 states in paragraph 2-1 that the DD Form 214 is a summary of a Soldier’s most recent period of continuous active duty. It provides a brief, clear-cut record of active duty service at the time of release from active duty, retirement, or discharge. For item 13, list awards and decorations for all periods of service, as listed in AR 600-8-22. Item 18 is to be used for Headquarters, Department of the Army, mandatory requirements when a separate block is not available and as a continuation for entries. It states: a. Mandatory entry: “SOLDIER (HAS) OR (HAS NOT) COMPLETED FIRST FULL TERM OF SERVICE.” This information assists the State in determining eligibility for unemployment compensation entitlement. b. Routinely, a RA Soldier should not be considered to have completed the first full term of service if separation occurs before the end of the initial contracted period of service. However, if a Soldier reenlists before the completion of that period of service, the first term of service is effectively redefined by virtue of the reenlistment contract. A prior service enlistee is considered to be on a second term of military service, even if that Soldier fails to complete the current term of service, the appropriate entry is “HAS”. 3. AR 670-1 (Wear and Appearance of Army Uniforms and Insignia), this regulation prescribes the authorization for wear, composition, and classification of uniforms, and the occasions for wearing all personal (clothing bag issue), optional, and commonly worn organizational Army uniforms. It also prescribes the awards, insignia, and accouterments authorized for wear on the uniform, and how these items are worn. General information is also provided on the authorized material, design, and uniform quality control system. The Combat Service Identification Badge and Overseas Service Bar are articles of clothing, and are not authorized to be listed on the DD Form 214. DISCUSSION: 1. The evidence of record shows he was awarded the Army Achievement Medal (2nd Award). This award is not listed on his DD Form 214. 2. Records show the applicant was on active duty from 9 April 2012 to 28 September 2015; a qualifying period of service for the GWOTSM. This award is not listed on his DD Form 214. 3. The applicant served a period of continuous honorable active service 9 April 2012 to 12 April 2015. He immediately reenlisted 13 April 2015; the first term of service is effectively redefined by virtue of the reenlistment contract. A prior service enlistee is considered to be on a second term of military service, even if that Soldier fails to complete the current term of service. In accordance with the governing regulation, the applicant completed his initial term of service; however, an entry in item 18 of his DD Form 214 shows he did not complete his first term of service. 4. The evidence of record shows the applicant qualified for the Sharpshooter Marksmanship Qualification Badge with Rifle Bar and Auto Rifle Bar and Marksman Marksmanship Qualification Badge with Machine Gun Bar; these qualification badges are not shown on his DD Form 214. 5. The Combat Service Identification Badge (CSIB) and Overseas Service Bar are not listed in AR 600-8-22. Therefore, they are not authorized to be listed on the DD Form 214.
