The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 31 October 2015 as follows: a. deleting the current entry in block 12a (Date Entered Active Duty this Period) and replacing it with the entry "1991 10 02"; b. adding to block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded of Authorized) the Army Good Conduct Medal (8th Award) and the Joint Service Achievement Medal (3rd Award). 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) for the period ending 31 October 2015 to show in: * Block 4a (Grade, Rate or Rank), his rank as first sergeant (1SG) instead of master sergeant (MSG) * Block 12a (Date Entered Active Duty this Period), the entry "1991 10 02" instead of "1991 11 02" * Block 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized), the Army Good Conduct Medal (8th Award) and the Joint Service Achievement Medal (3rd Award) 2. The applicant states the information on the DD Form 214 worksheet was pre-loaded with these errors. He did not receive the worksheet until minutes before his final processing appointment; therefore, he did not have adequate time to catch all the mistakes. 3. The applicant provides: * DD Form 4 (Enlistment/Reenlistment Document Armed Forces of the United States) * three certificates and citations for the Joint Service Achievement Medal * Orders 356-04, issued by the White House Communications Agency, Washington, DC, on 22 December 2014 * Orders 280-01, issued by the White House Communications Agency, Washington, DC, on 7 October 2015 * Enlisted Record Brief (ERB), dated 9 October 2015 * DD Form 214 for the period ending 31 October 2015 CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 2 November 1991. 2. Permanent Orders Number 121-5, issued by Headquarters, U.S. Southern Command on 30 April 1996, awarded him the Joint Service Achievement Medal for service during the period 1 November 1995 to 15 January 1996. 3. Joint Staff Permanent Order J-1SO-0240-98, issued by The Joint Staff, Washington, DC on 10 September 1998, awarded him the Joint Service Achievement Medal (2nd Award) for service during the period 4-14 August 1998. 4. The applicant's Official Military Personnel File contains a certificate for the Joint Service Achievement Medal that shows he was awarded the Joint Service Achievement Medal (3rd Award) on 5 June 2001. The Joint Service Achievement Medal citation provided by the applicant shows the award was for the period 6 March to 30 June 2001. 5. The applicant was promoted to the rank/grade of MSG/E-8 on 1 January 2012. 6. A DA Form 4187 (Personnel Action), dated 1 October 2012, shows he was laterally appointed to the rank of 1SG on 1 October 2012. 7. The applicant's Noncommissioned Officer Evaluation Report (NCOER) for the period 18 May 2014 to 17 May 2015, his last NCOER of record, shows he was performing duties as the NCO in Charge (NCOIC), Broadcast Systems Maintenance Division, in the rank of MSG. 8. Orders 280 -01, issued by the White House Communications Agency on 7 October 2015, awarded the applicant the Army Good Conduct Medal (8th Award) for the period 2 October 2012 to 1 October 2015. 9. Orders 356-04, issued by the White House Communications Agency on 22 December 2014, directed the applicant's retirement effective 31 October 2015. These orders show his rank at the time as MSG and that he was to be placed on the Retired List in the rank of 1SG. 10. The applicant was retired on 31 October 2015. His DD Form 214 shows in: * block 4a, his rank as MSG * block 12a, the entry "1991 11 02" * block 13, the Joint Service Achievement Medal and the Army Good Conduct Medal (7th Award), among other awards REFERENCES: 1. Army Regulation 635-8 (Separation Processing and Documents) prescribes the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It establishes standardized policy for the preparation of the DD Form 214. Chapter 5 contains guidance on the preparation and distribution of the DD Form 214 and states that block 4 will show the active duty grade or active duty rank and pay grade at the time of separation. 2. Army Regulation 635-200 (Personnel Separations – Enlisted Personnel), paragraph 12-17 (Grade Title on Retired List of Former First Sergeants) states that NCOs holding the rank of MSG at retirement, whose records show successful service as a 1SG, will be placed on the Retired List in the rank title 1SG. DISCUSSION: 1. The applicant's DD Form 4 shows he enlisted in the Regular Army on 2 October 1991; however, his DD Form 214 shows he entered active duty on 2 November 1991. It appears the incorrect date of entry on active duty was recorded on his DD Form 214. 2. His DD Form 214 shows he was awarded the Army Good Conduct Medal (7th Award); however, orders show he was awarded the Army Good Conduct Medal (8th Award) on 7 October 2015. 3. His DD Form 214 shows he was awarded one Joint Service Achievement Medal; however, his records show he was awarded the Joint Service Achievement Medal (3rd Award). 4. The evidence of record shows he met the eligibility criteria for placement on the Retired List in the rank of 1SG. As his retirement orders reflect, he was placed on the Retired List in the rank of 1SG. 5. However, he was serving in the rank of MSG at the time of his retirement. His DD Form 214 is meant to reflect his status as of his last day of active service. As of that date, he held the rank of MSG.
