Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "xx3-xx-xxxx" instead of "xx8-xx-xxxx." 2. The applicant states, in effect, his DD Form 214 incorrectly lists the third digit of his SSN as "8"; it should read "3." He requests this correction so that no one will question the SSN on his DD Form 214. 3. The applicant provides an Honorable Discharge Certificate; Letter Orders Number 03-1112159, dated 22 March 1972; his SSN card; and his DD Form 214, ending 10 April 1969. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 26 April 1966. 3. His available service record shows: * the entry for SSN on his DD Form 398 (Statement of Personal History) is blank * most of the documents in his record either display his military serial number or reflect the third digit of his SSN as "8" * Unit Orders Number 25, dated 15 May 1968, issued by Battery B, 5th Battalion, 1st Artillery, promoted him to specialist four; it shows the third digit of his SSN as "3" 4. He was honorably released from active duty on 10 April 1969. Item 3 (SSN) of his DD Form 214 lists the third digit of his SSN as "8." 5. The applicant provides three documents that list his SSN as "xx3-xx-xxxx" (the number "3" in the third digit): SSN card; Honorable Discharge Certificate, dated 25 April 1972; Letter Orders Number 03-1112159, dated 22 March 1972, issued by the U.S. Army Reserve Components Personnel and Administration Center. REFERENCES: Army Regulation 635-5 (Personnel Separations - Separation Documents), in effect at the time, prescribed policies and procedures for the completion of the DD Form 214. Source documents include the DA Form 20 as well as orders. This regulation essentially states item 3 will show the SSN, as listed in source documents. DISCUSSION: The evidence indicates the SSN listed on Unit Orders Number 25, dated 15 May 1968, reflecting the third digit of his SSN as "3," is his correct SSN.
