Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 23a (Specialty Number and Title) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his military occupational specialty (MOS) as Nuclear Weapons (MOS 12E – Atomic Demolition Munitions Specialist) instead of MOS 51N (Water Supply Specialist). 2. The applicant states his MOS is listed incorrectly on his DD Form 214 and this is an injustice because he never performed the job of water supply specialist. He worked with nuclear weapons. Correction of his DD Form 214 would give him peace of mind and pride for the job he performed in the Army. 3. The applicant provides no additional evidence. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 16 April 1966. 3. Headquarters, U.S. Army Training Center and Fort Leonard Wood, Special Order Number 236, dated 24 August 1966, shows he was awarded primary MOS 12A (Pioneer). 4. A statement from the Assistant Secretary, U.S. Army Engineer School, dated 2 June 1967, states he successfully completed the Atomic Demolitions Course during the period 9 January 1967 to 24 January 1967. 5. Headquarters, 82d Engineer Battalion, Special Orders Number 39, dated 21 February 1968, awarded him primary MOS 51N and secondary MOS 12B (Combat Engineer) and withdrew primary MOS 12B. 6. Item 22 (MOS) of his DA Form 20 (Enlisted Qualification Record) shows award of secondary MOS 12B effective 26 January 1967 and award of primary MOS 51N effective 21 February 1968. 7. On 23 April 1968, he was honorably released from active duty. He completed 1 year, 11 months, and 7 days of creditable active service. Item 23a of his DD Form 214 shows MOS 51N. 8. His records are void of and he failed to provide any evidence showing he was awarded MOS 12E. REFERENCES: Army Regulation 635-5 (Personnel Separation – Separation Documents), in effect at the time, stated to enter the primary MOS code number and title. If the specialty represented by the MOS had a related civilian occupation, enter in item 23b (Related Civilian Occupation and Dictionary of Occupational Title Number) the appropriate job title and code number from the dictionary of occupational titles. If not applicable, enter "NA." DISCUSSION: 1. The applicant contends he worked with nuclear weapons and his MOS is listed incorrectly on his DD Form 214. 2. The evidence of record shows he completed the Atomic Demolitions Course; however, his records are void of and he failed to provide any evidence showing he was awarded MOS 12E. 3.
