Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as "XXX-XX-XX60" instead of "XXX-XX-XX06." 2. The applicant states the SSN recorded on his 19 August 1967 DD Form 214 is incorrect. He requests correction of his DD Form 214 to show the SSN that is listed on his social security card. 3. The applicant provides: * social security card * DD Form 214 * discharge orders CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. A DD Form 4 (Enlistment Record – Armed Forces of the United States) shows the applicant enlisted in the U.S. Army Reserve on 21 November 1965. At the time the applicant enlisted, the Armed Forces did not use the SSN for identification purposes. He was issued a service number. The DD Form 4 shows in item 37 (Remarks) SSN “XXX-XX-XX60.” 3. On 21 December 1965, the applicant completed and signed a DD Form 398 (Statement of Personal History) and he entered his SSN as “XXX-XX-XX60.” 4. His DD Form 214 shows he entered active duty for training on 21 April 1967 and he was honorably released on 19 August 1967. Item 3 (SSN) contains the entry “XXX-XX-XX06.” REFERENCES: Army Regulation 635-5 (Personnel Separations – Separation Documents), in effect at the time, prescribed policies and procedures regarding separation documents. It also established standardized policy for preparing and distributing the DD Form 214. Section III (Instructions for Preparation and Distribution of the Armed Forces of the United States Report of Transfer or Discharge) states, in pertinent part, that all available records will be used as a basis for the preparation of the DD Form 214, including the Enlisted Qualification Record, Officer Qualification Record, and orders. The instructions show for item 3, transcribe SSN from DA Form 2139 (Military Pay Voucher). DISCUSSION: 1. The Armed Forces was not using the SSN for identification purposes at the time the applicant enlisted. However, the applicant recorded his SSN as “XXX-XX-XX60” on his DA Form 398 and DD Form 4 during the enlistment process as an Army Reservist. 2.
