THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show completion of high school. 2. The applicant states the box pertaining to high school graduation or equivalency was checked "No." He graduated from high school and he has a high school diploma. 3. The applicant provides his Secondary School Record – Student description Summary. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant’s failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant’s failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the North Carolina Army National Guard (NCARNG) on 12 December 1979. His enlistment contract and allied documents are not available for review. 3. He entered active duty for training (ADT) on 6 August 1989 and he was honorably released from ADT on 7 November 1980. His DD Form 214 shows in item 16 (High School Graduate or Equivalent) an "X" in the "Yes" block, indicating he was a high school graduate or equivalent at the time of separation, 4. He appears to have been discharged from the NCARNG on or about 4 December 1980. 5. He enlisted in the U.S. Army Reserve (USAR) under the Delayed Entry Program on 8 December 1980. Item 22 (Education) of his DD Form 1966/2 (Record of Military Processing) shows he attended high school at Jacksonville Senior High School from September 1973 to June 1976 and graduated and received a diploma. 6. He enlisted in the Regular Army on 6 January 1981 and he reenlisted on 5 October 1984. He held a transportation military occupational specialty. 7. Item 17 (Civilian Education and Military Schools) of his DA Form 2-1 (Personnel Qualification Record) shows he graduated from Jacksonville Senior High School in 1976. 8. He was discharged from active duty on 27 July 1987. His DD Form 214 for this period of service shows in item 16 (High School Graduate or Equivalent) an "X" in the "No" block, indicating he was not a high school graduate at the time of separation 9. He provides a "Secondary School Record - Student Description Summary" that confirms he graduated from high school in June 1976. REFERENCE: Army Regulation 635-5 (Separation Documents) establishes the standardized policy for preparing and distributing the DD Form 214. Item 16 shows an "X" in the appropriate block and is taken from the Soldier's records. DISCUSSION: The applicant's records clearly confirm his completion of high school in June 1976. He enlisted in the NCARNG in 1979 and received a DD Form 214 (for his ADT) that reflects completion of high school. His subsequent DD Form 214 for his Regular Army service ending on 27 July 1987, however, contains an error.
