THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) for the period ending 6 November 1971 to show his social security number (SSN) as "XXX-56-XXXX" instead of "XXX-65-XXXX." 2. The applicant states, in effect, his SSN is incorrectly typed on his DD Form 214 as a result of a transposition error. 3. The applicant provides his DD Form 214, a National Guard Bureau (NGB) Form 55 (Honorable Discharge Certificate), and his social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant’s military records are not available for review. His records were requested from the National Personnel Records Center in St. Louis, MO; however, none were located. Notwithstanding, the documents he provides are sufficient for the Board to conduct a fair and impartial review of his case. 3. The applicant enlisted in the Michigan Army National Guard (MIARNG) on 19 January 1971. He entered active duty for training on 8 June 1971, for the purpose of completing his initial entry training. 4. The applicant completed his initial entry training, was awarded military occupational specialty 05C (Radio Operator), and was released from active duty (REFRAD) on 6 November 1971. Upon his REFRAD, he was returned to the control of the MIARNG. His DD Form 214 shows his SSN as "XXX-65-XXXX." 5. The applicant provides a copy of his social security card, which shows his SSN as "XXX-56-XXX." He also provides his NGB Form 55, dated 18 January 1977 (his terminal date of reserve obligation), which shows his SSN as "XXX-56-XXXX." This document was signed by his commanding officer. REFERENCES: Army Regulation 635-5 (Separations Documents), in effect during the applicant's active duty service, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. DISCUSSION: Although the applicant's record is not available for review, he does provide an NGB Form 55 that shows the SSN he states in his application. This constitutes evidence that he served under the SSN he now claims is correct.
