Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 23a (Specialty Number and Title) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge), for the period ending 9 April 1971, to show his military occupational specialty (MOS) title as Helicopter Crew Chief instead of Helicopter Repairman. 2. The applicant states he was not a helicopter repairman; he was a helicopter crew chief. He attended school at Fort Eustis, VA, from 1968 to 1969 and he served as a crew chief in Vietnam. 3. The applicant provides a copy of his DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 5 September 1968 for training in MOS 68E (Aircraft Rotor and Propeller Repairman). 3. On 21 January 1969, he waived his enlistment option for MOS 68E in favor of training in MOS 67N (Utility Helicopter (UH)-1 Helicopter Repairman). 4. Special Order Number 62, issued by the U.S. Army Transportation School, Fort Eustis, VA, on 31 March 1969, awarded him MOS 67N. 5. The applicant served in the Republic of Vietnam from on or about 30 April 1969 through on or about 8 April 1971. 6. The applicant's record contains orders that show he was awarded the Air Medal for heroism in Vietnam while serving as a crew chief with the 71st Aviation Company. 7. The applicant was released from active duty on 9 April 1971. Item 23a of his DD Form 214 contains the entry "67N2O UH-1 Hel [Helicopter] Rpmn [Repairman]." REFERENCES: Army Regulation 611-201 (Enlisted Career Management Fields and Military Occupational Specialties), in effect at the time, provided that the official title for MOS 67N was UH-1 Helicopter Repairman. DISCUSSION: 1. The applicant contends the MOS title on his DD Form 214 should be changed from Helicopter Repairman to Helicopter Crew Chief. He bases his contention on the fact that he served as a crew chief while in Vietnam. 2. The governing Army regulation in effect at the time provided that the official title for MOS 67N was UH-1 Helicopter Repairman. It is acknowledged that he performed duties as helicopter crew chief while in Vietnam; however, the term "crew chief" pertains to his duty description at the time, not his MOS title. 3.
