Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of her DD Form 214 (Report of Separation from Active Duty) to show her social security number (SSN) as 493-XX-XXXX. 2. The applicant states her DD Form 214 contains a clerical error. Her SSN is 493-XX-XXXX, but her DD Form 214 shows her SSN as 492-XX-XXXX. Her veterans' health benefits are being denied due to this error. 3. The applicant provides her DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. In connection with her enlistment in the Regular Army, the applicant completed a DD Form 398 (Statement of Personnel History) on 4 March 1974 and listed her SSN as 493-XX-XXXX in item 13 (Employment). 3. She enlisted in the RA on 12 March 1974. Item 1 (Service No./SSAN) of her DD Form 4 (Enlistment Contract – Armed Forces of the United States), dated 12 March 1974, shows her SSN as 492-XX-XXXX. 4. Her DA Form 2-1 (Personnel Qualification Record – Part II), which was created upon her entry on active duty, shows her SSN as 492-XX-XXXX. 5. The applicant was honorably released from active duty on 11 April 1977. Item 3 (SSN) of her DD Form 214 shows her SSN as 492-XX-XXXX. 6. She provided a copy of her social security card which lists her SSN as 493-XX-XXXX. REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form is complete and accurate. DISCUSSION: 1. In connection with her enlistment in the Regular Army, the applicant listed her SSN as 493-XX-XXXX on her DD Form 398. This SSN is consistent with the SSN shown on her social security card. 2. The applicant's records show her SSN was recorded as 492-XX-XXXX when she enlisted on 12 March 1974 and carried forward in the majority of subsequently prepared documents. 3.
