Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show his service with the Multinational Force and Observers (MFO) in Sinai, Egypt, and that he was awarded the MFO Medal. 2. The applicant states he was in the Sinai Peninsula, Egypt, with the MFO from December 1985 through May 1986, attached to the 3rd Battalion, 60th Infantry Battalion. This service was not included on his DD Form 214. He also received a Multi-National Peacekeeping Forces and Observers Medal that is not on his DD Form 214 in relation to this assignment, and the award should be included on a DD Form 215 (Correction to DD Form 214.) 3. The applicant provides: * locally-produced 3rd Battalion, 60th Infantry, unit memento * Letter of Commendation, issued by Headquarters, 3rd Battalion, 60th Infantry, Fort Lewis, WA, dated 15 November 1985 * flight manifest listing personnel deploying to Egypt * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 3 August 1983, the applicant enlisted in the Regular Army. After initial training, he was awarded military occupational specialty 73C (Finance Specialist). 3. The applicant’s DA Form 2-1 (Personnel Qualification Record), item 35 (Record of Assignments), shows he was attached to the 9th Finance Company, Fort Lewis, WA, from 16 July 1984 to 2 June 1987. 4. The applicant’s record shows a DD Form 1610 (Request and Authorization for temporary duty (TDY) Travel of Department of Defense (DOD) Personnel), dated 17 October 1985, which show the following: a. Item 9 (Purpose of TDY) – “Temporary duty with the Sinai MFO.” b. Item 17 (Itinerary) – he departed from Fort Lewis WA to Cairo, Egypt and to the MFO Headquarters, Sinai, and will return upon completion of TDY. c. Item 19 (Accounting Citation) – lists the accounting authorization. d. Item 20 (Order Authorizing Officer) – signed by a captain (CPT) who was the Assistant Adjunct General. e. Item 21 (Date Issued) – “21 Oct 85.” f. Item 22 (Travel Order Number) – “AJA0355 10-621.” 4. The applicant provides: a. Army Achievement Medal Certificate, dated 30 April 1986, showing he received the award for meritorious achievement while attached to Headquarters, Headquarters Command, 3th Battalion, 60th Infantry, MFO, Sinai, Egypt, from 11 December 1985 to 26 May 1986, a period of 5 months and 16 days. b. Permanent Orders (PO) 54-9, issued by the DA, 9th Personnel Service Company, Fort Lewis, WA, dated 19 May 1986, showing he was awarded the AAM for the period of service from 11 December 1985 to 26 May 1986 for meritorious achievement. 5. On 2 June 1987, the applicant was honorably released from active duty. His DD Form 214 shows in: * item 12f (Foreign Service) – "0000 00 00” * item 13 (Decorations, Medals, Badges, Citations, and Campaign Ribbons Awarded or Authorized) – no entry for the MFO Medal * Item 18 (Remarks) – no reference to a deployment 6. There is no documentation that shows he was awarded the MFO Medal. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) states the Multinational Force and Observers Medal was accepted by the President for the U.S. Armed Forces on 28 July 1982. Effective 15 March 1985, personnel must serve 6 months (170 days minimum) with the MFO to qualify for the award. 2. Army Regulation 635-5 (Separation Documents), the regulation in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. This regulation states to enter the total amount of foreign service completed during the period of service in item 12c. Item 18 is used to document a Soldier's participation in foreign deployments in support of named operations. Its instructions provide that for active duty Soldiers, deployed with their unit during their continuous period of active service, the statement "SERVICE IN (name of country deployed) FROM (inclusive dates, for example, YYYYMMDD-YYYYMMDD)." DISCUSSION: 1. The applicant contends, in effect, that his service with the MFO in Sinai, Egypt is not listed on his DD Form 214, and that his is entitled to the MFO Medal, which is also not included on his DD Form 214. 2. The applicant provides a AAM Certificate and PO 54-9, issued by the DA, 9th Personnel Service Company, Fort Lewis, WA, dated 19 May 1986 that shows he was assigned to the MFO in Sinai, Egypt. 3. Pursuant to Army Regulations 600-8-22, the applicant must have served a period of at least 6 months (170 days minimum) to qualify for the MFO Medal. He did not serve the minimum 170 days required for award of the MFO Medal. 4. The applicant’s record shows that he received travel orders and was authorized for TDY travel to Cairo, Egypt, for assignment to the MFO Headquarters in Sinai, Egypt. 5. He received a AAM for meritorious achievement while attached to HHC, 3rd Battalion, 60th Infantry, MFO, Sinai, Egypt, which confirms his foreign service time in Egypt.
