Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) and his DD Form 256A (Honorable Discharge Certificate) to show his social security number (SSN) as listed on the social security card he provided. 2. The applicant states: a. His DD Form 214 and his DD Form 256A both show the number "6" as the third digit of his SSN. b. The third digit of his SSN is "9" not "6." c. This is most likely a typographical error because other documents he has in his possession from his military records reflect the correct SSN. 3. The applicant provides his social security card and Headquarters, 4th Infantry Division, Special Orders Number 22, dated 22 January 1969. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 27 February 1967. 3. On 7 March 1967, a DA Form 3027 (US Army Request for National Agency Check) was completed on the applicant. This document lists a different SSN than the SSN listed on the social security card he provided. 4. On 6 July 1968, the applicant completed a DD Form 398 (Statement of Personal History), which does not list an SSN. He also completed a DA Form 41 (Record of Emergency Data) which shows the SSN listed on his social security card. 5. The applicant was released from active duty on 15 February 1969. The SSN listed on the DD Form 214 that he received is different than the SSN listed on the DA Form 3027 and the DA Form 41. 6. A review of the applicant's Official Military Personnel File (OMPF) fails to reveal a copy of his DD Form 256A. However, his OMPF shows that three different SSNs are listed on the documents contained therein. He does provide copies of his social security card and Headquarters, 4th Infantry Division, Special Orders Number 22 showing the same SSN as the SSN shown on his DA Form 41 and his social security card. REFERENCES: 1. Army Regulation 635-5 (Separation Documents), then in effect, prescribed the separation documents prepared for Soldiers upon retirement, discharge, or release from active military service or control of the Army. It established standardized policy for the preparation of the DD Form 214. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It provided a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. 2. Army Regulation 635-8 (Separation Processing and Documents), currently in effect, provides the instructions for completing DD Form 256A. It states the SSN will not be entered on DD Form 256A. DISCUSSION: 1. The applicant's DA Form 41 and Special Orders Number 22 show the same SSN as that shown on his social security card. 2. It is unclear how three different SSNs came to be recorded in the applicant's record. It appears to have been the result of administrative errors made during his service. It appears these administrative errors led to the entry of an incorrect SSN on his DD Form 214. 3. He did not provide a copy of his DD Form 256A and a review of his OMPF fails to reveal a copy of the form contained therein. There is no evident reason to doubt his claim that the SSN on this form is different than the SSN recorded on his social security card. The SSN is no longer recorded on DD Form 256A.
