Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests amendment of his reentry eligibility (RE) code from RE-3 to RE-1 or approval of a waiver to enlist again. 2. The applicant states: a. Giving him an RE code of "3" and denying him a waiver bars him from serving in the military. b. At the time he was in the Army, he was not suffering from any physical or mental issues. He was stressed over a death in his family. c. He does not have his military records anymore. He is currently waiting for them to come in the mail. d. When he was in basic training, his sister was sick with multiple sclerosis (MS). He got word that she was not doing well and he went into a state of depression. She passed away shortly after he got home from basic training. He did not believe he would see her again. 3. The applicant provides: * his sister's obituary * self-authored letter (undated) * electronic mail from a medical doctor, dated 25 February 2016 * DD Form 214 (Certificate of Release or Discharge from Active Duty), dated 19 June 2013 (two copies) CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 17 April 2013. 2. The facts and circumstances pertaining to his discharge are not available for review. 3. His DD Form 214 shows he was discharged on 19 June 2013 under the provisions of Army Regulation 635-200, paragraph 5-1, due to failed medical/physical procurement standards. He was assigned a separation program designator code of "JFW" and an RE code of "3." 4. The applicant provided a copy of his sister's obituary which shows she died on 1 August 2013. He also provided electronic mail from a medical doctor stating that after inpatient and outpatient treatment from 30 August 2001 to 29 May 2009, there is currently no evidence of anxiety, depression, or impaired reality testing. The doctor further stated the applicant’s mental status exam shows no signs of pathology. REFERENCES: 1. Army Regulation 601-210 (Active and Reserve Components Enlistment Program) states that prior to discharge or release from active duty, individuals will be assigned RE codes based on their service records or the reason for discharge. Chapter 3 prescribes basic eligibility for prior-service applicants for enlistment and includes a list of Armed Forces RE codes. An RE code of "3" applies to persons who have a waivable disqualification. 2. Army Regulation 635-5-1 (SPD Codes) prescribes the specific authorities (regulatory, statutory, or other directives) and reasons for the separation of members from active military service and the SPD code to be used for these stated reasons. SPD code "JFW" applies to Soldiers discharged due to failing medical procurement standards. 3. The SPD/RE Code Cross Reference Table provides instructions for determining the RE code for Regular Army Soldiers and Reserve Component Soldiers. SPD code "JFW" has a corresponding RE code of "3." DISCUSSION: 1. His records show he was discharged from the Army for failure to meet medical/physical procurement standards. He was assigned SPD code "JFW," which applies to the reason for his discharge. He was assigned RE code "3," which corresponds to his SPD code. 2. An RE code of "3" applies to persons who are not considered fully qualified for reentry or continuous service; however, it does allow for a waiver of the disqualification. Therefore, if he desires to reenlist, he should contact a local recruiter who can best advise him on his eligibility for returning to military service.
