Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DA Form 8-274 (Medical Condition – Physical Profile Record), dated 19 June 1968, and item 2 (Service Number) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his service number as US XX 4XX 9XX. 2. The applicant states his service number is incorrect on these forms due to clerical errors. He never thought it was necessary to proofread these forms because he thought the Government would have gotten things right. 3. The applicant provides: * DA Form 8-274 * port call instructions, dated 29 January 1968 * signature page of Special Orders Number 198, dated 4 August 1968 * DD Form 214 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 16 August 1966. His DD Form 47 (Record of Induction) shows his service number as US XX 4XX 9XX. 3. He provided Headquarters, 25th Infantry Division, port call instructions, dated 29 January 1968, showing his service number as US XX 4XX 9XX. 4. His DA Form 8-274, dated 19 June 1968, shows his service number as US XX 0XX 1XX. 5. He provided the signature page of Headquarters, Fort Campbell, Special Orders Number 198, dated 4 August 1968, showing his service number as US XX 4XX 9XX. 6. On 6 August 1968, he was honorably released from active duty. Item 2 of his DD Form 214 shows his service number as US XX 4XX 4XX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It stated the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active duty. It established standardized policy for preparing and distributing the DD Form 214. The general instructions stated all available records would be used as a basis for preparation of the DD Form 214. The specific instructions for item 2 stated to enter the individual's service number and authorized prefix. DISCUSSION: 1. The applicant's DD Form 47 shows his service number as US XX 4XX 9XX when he was inducted into the Army of the United States on 16 August 1966. 2. However, his DA Form 8-274, dated 19 June 1968, shows his service number as US XX 0XX 1XX and his DD Form 214 shows his service number as US XX 4XX 4XX. 3.
