Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XXX-82-XXXX. 2. The applicant states his DD Form 214 contains a clerical error. His SSN is XXX-82-XXXX, not XXX-32-XXXX. 3. The applicant provides his DD Form 214 and social security card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. In connection with his enlistment in the Regular Army, the applicant completed a DD Form 398 (Statement of Personnel History) on 4 June 1968 and listed his SSN as XXX-82-XXXX in item 13 (Employment). 3. He enlisted in the Regular Army on 5 June 1968. 4. The majority of documents in the applicant's military personnel records consistently show his SSN as XXX-82-XXXX, to include the following: * DD Form 4 (Enlistment Contract – Armed Forces of the United States), dated 5 June 1968 * DD Form 1584 (National Agency Check Request) dated 13 June 1968 * DA Form 20 (Enlisted Qualification Record), audited on 22 July 1970 5. The applicant was honorably released from active duty on 4 June 1971. Item 3 (SSN) of his DD Form 214 shows his SSN as XXX-32-XXXX. 6. He provided a copy of his social security card which lists his SSN as XXX-82-XXXX. REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form is complete and accurate. DISCUSSION: The applicant's DD Form 398 shows the applicant disclosed his SSN as XXX-82-XXXX upon his enlistment in the Regular Army. This SSN is consistent with the SSN listed in the majority of the documents in his service record and the SSN listed on the social security card he provided.
