Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Certificate of Release or Discharge from Active Duty) to show completion of the Primary Leadership Development Course (PLDC), the Basic Noncommissioned Officer Course (BNCOC) and two Yugoslavia campaign medals. 2. The applicant states there is no record of the above training and medals on his DD Form 214. 3. The applicant provides: * DA Form 1059 (Service School Academic Evaluation Report) and certificate confirming completion of PLDC * 2 DA Forms 1059 confirming completion of BNCOC * 2 Certificates of Appreciation * Permanent Orders 039-001 * Manifest for Personnel going to Fort Benning, GA * 2 DD Forms 1610 (Request and Authorization for TDY Travel of DOD Personnel) * Certificate for award of the North Atlantic Treaty Organization (NATO) Medal * Army Superior Unit Award approval memorandum and list of units CONSIDERATION OF EVIDENCE: 1.  Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2.  The applicant enlisted in the Regular Army on 25 March 1994 and reenlisted on 8 December 1999. He held military occupational specialty 68N2P (Avionic Mechanic). 3.  His records contain a DA Form 1059 that shows he attended and successfully completed PLDC from 4 January to 3 February 2000 (4 week duration). 4.  His record contains two additional DA Forms 1059 showing he attended and successfully completed BNCOC Common Core Phase I from 15 to 31 August 2001 (2-week duration) and Avionic Mechanic BNCOC from 4 to 28 September 2001 (3-week duration). 5.  He was honorably discharged from active duty on 7 December 2002. His DD Form 214 shows in: * item 12f (Foreign Service) – zero credit * item 13 (Decorations, Medals, Badges, Citations and Campaign Ribbons Awarded or Authorized) among his awards the NCO Professional Development Ribbon with Numeral 2 * item 14 (Military Education) – Field Sanitation Course, 1 week, May 1997 * item 18 (Remarks) – no entries regarding deployments 6.  An email from the Defense Finance and Accounting Service (DFAS), dated 14 June 2017, confirmed the applicant served in Bosnia, a combat zone, from 1 May 1997 to 31 October 1997. 7.  He provided: a. Certificate of Appreciation, undated, recognizing him for outstanding support of Task Force Eagle during Stabilization Force in Bosnia and Herzegovina (SFOR)-5, while assigned to 1st Battalion, 159th Aviation Regiment; b. Certificate of Appreciation, undated, recognizing him for outstanding contributions to the successful peace mission in the Former Republic of Yugoslavia during Operation Joint Guard, while assigned to 1st Battalion, 159th Aviation Regiment; c. Permanent Orders 039-001, dated 8 February 1999, ordering Headquarters and Headquarters Company (HHC), 1st Battalion, 159th Aviation deployed to Germany in support of Operation Joint Forge; d. Manifest for Personnel going to Fort Benning, GA, dated 15 March 1999, listing the names of several personnel, including the applicant's, indicating these personnel would go from Fort Bragg to Fort Benning for training; e. DD Form 1610, group travel order, dated 10 March 1999, authorizing HHC, 1st Battalion, 159th Aviation to depart Fort Bragg for movement to Fort Benning for training; f. DD Form 1610, group travel order, dated 15 March 1999, authorizing HHC, 1st Battalion, 159th Aviation to depart Fort Bragg and arrive at Fort Benning on 14 March 1999, then depart Fort Benning on 22 March 1999 to Bosnia, arriving on or about 23 March 1999; g. Certificate, awarding him the NATO Medal for service with NATO for operations in relation to the Former Republic of Yugoslavia during the period May 1997 to October 1997; and h. memorandum, dated 15 September 1998, issued by the now-known as U.S. Army Human Resources Command, approving award of the Army Superior Unit Award to Task Force Eagle SFOR from 4 April 1997 to 21 October 1997. Attached to the approval memorandum is a listing of units and their dates of deployment. HHC, 1st Battalion, 159th Aviation dates are shown as 4 April 1997 to 29 October 1997. REFERENCES: 1. Army Regulation 635-5 (Separation Documents) established the standardized policy for preparing and distributing the DD Form 214. Chapter 2 contained guidance for preparation of the DD Form 214. The instructions stated: * item 12f – obtained from the Soldier's records, list the total amount of foreign service completed during the period covered by the DD Form 214 * item 13 – obtained from the Soldier's records, list all awards and decorations * item 14 – list all formal, in-service (full time attendance) training courses successfully completed during the period of service covered by the DD Form 214 of at least 1 week or 40 hours duration * item 18 – for an active duty Soldier deployed with his or her unit during their continuous period of active service, the statement "SERVICE IN (name of country deployed) FROM (inclusive dates for example, YYYYMMDD-YYYYMMDD)" 2. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. a. The Armed Forces Expeditionary Medal is awarded for qualifying service after 1 July 1958 in U.S. military operations, U.S. operations in direct support of the United Nations, and U.S. operations of assistance for friendly foreign nations. Qualifying service for this award includes participation in the Former Republic of Yugoslavia for Operations Joint Endeavor and Joint Guard from 1 June 1992 to 20 June 1998 (only for participants deployed to Bosnia-Herzegovina and Croatia). b. The Armed Forces Service Medal is awarded to members of the Armed Forces of the United States who, after 1 June 1992, participate or have participated as members of U.S. military units, in a U.S. military operation that is deemed to be a significant activity; and encounter no foreign armed opposition or imminent threat of hostile action. It may be authorized for the significant U.S. military activities for which no other U.S. campaign or service medal is appropriate, such as peacekeeping operations and/or prolonged humanitarian operations. It may also be awarded for U.S. military operations in direct support of the United Nations or NATO and for operations of assistance to friendly foreign nations. A member must be bona fide members of a unit participating in or engaged in direct support of the operation for 30 consecutive days in the area of operations (or for the full period when an operation is less than 30 days' duration) or for 60 consecutive days provided this support involves entering the area of operations. c. Pursuant to section 572 of Public Law 105-85, service members awarded the Armed Forces Expeditionary Medal for qualifying service in Bosnia-Herzegovina and Croatia are authorized both the Armed Forces Expeditionary Medal and the Armed Forces Service Medal. DISCUSSION: 1. Based on the applicant's DFAS pay records, he served in Bosnia for 6 months with HHC, 1st Battalion, 159th Aviation Regiment from 1 May 1997 to 31 October 1997. This period of service is consistent with that mentioned on his NATO certificate. Item 12f of his DD Form 214 does not list this foreign service and item 18 does not reflect it as a deployment. 2. Based on this period of service, the applicant served a qualifying period in Bosnia during Operation Joint Endeavor for award of the Armed Forces Expeditionary Medal and the Armed Forces Service Medal, neither of which is listed on his DD Form 214. He was also awarded the NATO Medal which is not listed on his DD Form 214. 3. His unit (HHC, 1st Battalion, 159th Aviation) was awarded the Army Superior Unit Award. This unit award is not listed on his DD Form 214. 4. He completed the 4-week PLDC and the 5-week BNCOC education courses in residence.
