Deleting the Army Commendation Medal and the Vietnam Service Medal from his DD 214; and b. THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests reconsideration of his earlier request for correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show a second award of the Army Commendation Medal. 2. The applicant states he was awarded the Army Commendation Medal with 1st Oak Leaf Cluster (2nd Award). The award is not reflected on his DD Form 214. He would like to have the award added to his records for his children and family. He also stated that his earlier request did not include the general orders issuing the award. 3. The applicant provides a copy of General Orders Number 4588, dated 26 April 1970, awarding him the Army Commendation Medal (2nd Award). CONSIDERATION OF EVIDENCE: 1. Incorporated herein by reference are military records which were summarized in the previous consideration of the applicant's case by the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150004976 on 19 November 2015. 2. The applicant enlisted in the Regular Army on 23 December 1968. 3. The applicant’s DA Form 20 (Enlisted Qualification Records) shows in: * item 31 (Foreign Service) he served in the Republic of Vietnam from 6 June 1969 to 3 June 1970 * item 38 (Record of Assignments) he was assigned to Battery C, 3d Battalion, 13th Artillery Regiment, 25th Infantry Division * item 41 (Awards and Decorations): * National Defense Service Medal * Vietnam Service Medal * Two Overseas Service Bars * Vietnam Campaign Medal with Device (1960) * Expert Marksmanship Qualification Badge (M-16) * Sharpshooter Marksmanship Qualification Badge (M-14) * Army Commendation Medal 4. The applicant was released from active duty on 22 September 1971. 5. The applicant’s DD Form 214 indicates he was awarded: * National Defense Service Medal * Vietnam Service Medal * Two Overseas Service Bars * Vietnam Campaign Medal with Device (1960) * Expert Marksmanship Qualification Badge (M-16) * Sharpshooter Marksmanship Qualification Badge (M-14) * Army Commendation Medal 6. The applicant provides a copy of General Order Number 4588, dated 26 April 1970, awarding him the Army Commendation Medal (2nd Award) for meritorious service for the period June 1969 to June 1970, while in the Republic of Vietnam. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) provides that the Army Commendation Medal may be awarded to any member of the Armed Forces of the United States who, while serving in any capacity with the Army after 6 December 1941, distinguishes himself or herself by heroism, meritorious achievement, or meritorious service. As with all personal decorations, formal recommendations, approval through the chain of command, and announcement in orders are required. An Oak Leaf Cluster denotes each subsequent award of this medal. 2. Army Regulation 600-8-22 (Military Awards) states a bronze service star will be awarded for wear on the Vietnam Service Medal for participation in each campaign. The applicant participated in four campaigns: * Tet 69/Counteroffensive, 23 February - 8 June 1969 * Vietnam Summer - Fall 1969, 9 June - 31 October 1969 * Vietnam Winter - Spring 1970, 1 November 1969 - 30 April 1970 * Sanctuary Counteroffensive, 1 May - 30 June 1970 3. Department of the Army Pamphlet 672-3 (Unit Citation and Campaign Participation Credit Register) lists the awards received by units serving in Vietnam. This pamphlet shows the unit to which the applicant was assigned was cited for award of the: * Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation for the period 1 April 1966 to 21 August 1970, by Department of the Army General Order Number 51, dated 1971 * Republic of Vietnam Gallantry Cross with Palm Unit Citation for the period 1 September 1968 to 30 September 1970, by Department of the Army General Order Number 5, dated 1973 DISCUSSION: 1. The applicant requests that his DD Form 214 be corrected to reflect the Army Commendation Medal (2nd Award). 2. General Order Number 4588, dated 26 April 1970 awarded the applicant the Army Commendation Medal (2nd Award). His DD Form 214 only lists one award. 3. He was awarded the Vietnam Service Medal and he participated in four campaigns. His DD Form 214 does not show the bronze service stars. 4. He served with the 3rd Battalion, 13th Artillery, during the period of which the united was cited for the Republic of Vietnam Civil Actions Honor Medal First Class Unit Citation and the Republic of Vietnam Gallantry Cross with Palm Unit Citation.
