Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XXX-XX-XX53 instead of XXX-XX-XX35. 2. The applicant states a typographical error occurred when his SSN was entered on his DD Form 214. 3. The applicant provides copies of his DD Form 214 and Order C-01-604099 from the U.S. Army Reserve (USAR) Personnel Center. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant entered Active Duty for Training (ACDUTRA) on 25 August 1965. 3. His DD Form 214 shows he was honorably released from active duty and transferred to the United States Army Reserve (USAR) on 31 December 1965. His SSN is listed with the eighth and ninth digits as “35.” 4. Letter Orders Number 05-1852, dated 20 May 1975, issued by the Fifth United States Army, Fort Sam Houston, TX, honorably released him from the USAR, effective 20 May 1975. These orders show his SSN with the eighth and ninth digits as “53.” 5. His record contains a Standard Form 93 (Report of Medical History) and a Standard Form 88 (Report of Medical Examination), both dated 7 May 1977, showing his SSN with the eighth and ninth digits as “53.” 6. The applicant provides USAR Personnel Center Orders Number C-01-604099, dated 30 January 1996, wherein his SSN is listed with the eighth and ninth digits as “53.” 7. His ARPC Form 249-2-E (Chronological Statement of Retirement Points), dated 6 September 2002, show the SSN entry with the eighth and ninth digits as “53.” REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs, in pertinent part, that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement or discharge. DISCUSSION: The applicant's record contains several personnel, medical, and legal documents that only show his SSN with the eighth and ninth digits listed as “53.” This is the SSN that is shown on his ARPC Form 249-2-E and USAR Personnel Center Orders C-01-604099.
