The Board determined the evidence presented is sufficient to warrant a recommendation for partial relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by deleting the current social security number (SSN) entry from his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) and adding the SSN shown on his Social Security Account Card. 2. The Board further determined the evidence presented is insufficient to warrant a portion of the requested relief. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his social security number (SSN) on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show "X0X-XX-XXXX" instead of "X4X-XX-XXXX." He also requests that the Army Board for Correction of Military Records (ABCMR) send him a copy of all his military records. 2. The applicant states the wrong SSN is listed on his DD Form 214. He needs his record corrected to reflect the correct SSN for benefits. He also states his military records were lost and he would like the Board to send him a copy of his military personnel records. 3. The applicant provides his social security account card, DD Form 214, and Special Orders Number 251. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was inducted into the Army of the United States on 14 December 1965. 3. His DA Form 20 (Enlisted Qualification Record) and his DA Form 41 (Record of Emergency Data) both show his SSN as "X0X-XX-XXXX." 4. The Army released him from active duty on 25 November 1967. His DD Form 214 shows his SSN as "X4X-XX-XXXX." 5. He provided his Social Security Account Card that shows his SSN as "X0X-XX-XXXX." REFERENCES: 1. Army Regulation 635-5 (Separation Documents), dated 23 January 1967, governed the preparation of the DD Form 214. It states that the DD Form 214 is a synopsis of the Soldier's most recent period of continuous active service. It provides a brief, clear-cut record of active Army service at the time of release from active duty, retirement, or discharge. 2. Army Regulation 15-185 (ABCMR) prescribes the policies and procedures for correction of military records by the Secretary of the Army, acting through the ABCMR. The ABCMR will decide cases on the evidence of record. 3. The ABCMR is not a records custodian; the National Personnel Records Center (NPRC), an agency of the National Archives and Records Administration, maintains control of military personnel records, now referred to as the Official Military Personnel File (OMPF). The OMPFs held at the NPRC are administrative records containing information about the subject's military service history. DISCUSSION: 1. The applicant entered active service on 14 December 1965. His DA Form 20 and DA Form 41 both show his SSN as "X0X-XX-XXXXX." 2. The social security account card he provided also shows his SSN as "X0X-XX-XXXX." 3. It is logical to conclude an administrative error occurred during the preparation of his DD Form 214. 4. The ABCMR is not a records custodian and is, therefore, unable to provide the requested copies of medical and personnel records.
