Board Determination/Recommendation 2. Evidence and Consideration BOARD DATE: 17 August 2017 DOCKET NUMBER: AR20160002713 BOARD DETERMINATION/RECOMMENDATION: The Board determined the evidence presented is sufficient to warrant a recommendation for relief. As a result, the Board recommends that all Department of the Army records of the individual concerned be corrected by amending item 3 of his DD Form 214 for the period ending 30 November 1973 to show the SSN listed on his social security card. _____________x____________ CHAIRPERSON I certify that herein is recorded the true and complete record of the proceedings of the Army Board for Correction of Military Records in this case. BOARD DATE: 17 August 2017 DOCKET NUMBER: AR20160002713 THE BOARD CONSIDERED THE FOLLOWING EVIDENCE: 1. Application for correction of military records (with supporting documents provided, if any). 2. Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his social security number (SSN) reflected on his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge). 2. The applicant states his entire work and military history have been based on his SSN. However, some jobs require the use of his DD Form 214 as a document to verify work history, as a result of this, he may not have received all of his social security points toward his benefits. 3. The applicant provides his DD Form 214, social security card, driver license, and Department of Veterans Affairs (VA) identification card. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 16 June 1972. His DD Form 4 (Enlistment Contract-Armed Forces of the United States) shows his SSN as 375-XX-XXXX. 3. In connection with his enlistment, the applicant completed a DD Form 98 (Armed Forces Security Questionnaire) and DD Form 369 (Police Record Check) listing his SSN as 357-XX-XXXX. 4. His DA Form 20 (Enlisted Qualification Record) lists his SSN as 375-XX-XXXX. 5. He was discharged from active service on 30 November 1973 under honorable conditions. His DD Form 214 shows he completed 1 year, 5 months, and 15 days of total active service. Item 3 (SSN) lists his SSN as 375-XX-XXXX. 6. The applicant provides: * social security card listing his SSN as 357-XX-XXXX * Driver license that does not list his SSN * VA identification card that does not list his SSN REFERENCE: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The regulation directs that the purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form should be complete and accurate. DISCUSSION: The applicant's DD Form 98 and DD Form 369 listed his SSN as 357-XX-XXXX. This SSN is consistent with the social security card he provides. It appears his DD Form 214 inadvertently lists an incorrect SSN. //NOTHING FOLLOWS// ABCMR Record of Proceedings AR20150000953 Enclosure 1 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS ABCMR Record of Proceedings (cont) AR20160002713 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 1 ABCMR Record of Proceedings (cont) AR20160002713 2 ARMY BOARD FOR CORRECTION OF MILITARY RECORDS RECORD OF PROCEEDINGS Enclosure 2
