Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as X32-xx-XXXX. 2. The applicant states the SSN shown on his DD Form 214 as X23-xx-XXXX is inaccurate. His correct SSN is X32-xx-XXXX. 3. The applicant provides: * photocopy of his social security card * Dutchess County Division of Veterans' Services letter, Department of Veterans Affairs (VA) Form 21-22 (Appointment of Veterans Service Organization as Claimant's Representative) * DA Form 20 (Enlisted Qualification Record), page 1 only * DD Form 398 (Statement of Personal History) * DD Form 214 * U.S. Army Reserve Components Personnel and Administration Center Letter Orders Number 02-1089300, dated 23 February 1972 CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant enlisted in the Regular Army on 29 March 1966. 3. His DA Form 20 shows his typed SSN as X32-xx-XXXX with a line drawn through it and X23-xx-XXXX handwritten underneath the typed SSN. 4. His DA Form 3027 (U.S. Army Request for National Agency Check), dated 29 March 1966, shows a handwritten SSN as X32-xx-XXXX. 5. Headquarters U.S. Army Personnel Center Far East, Japan, Special Orders Number 58, dated 22 March 1968, show his SSN as X32-xx-XXXX. 6. He was honorably released from active duty on 2 December 1968. Item 3 (Social Security Number) of his DD Form 214 shows his SSN as X23-xx-XXXX. 7. His records do not contain a DA Form 2139 (Military Pay Voucher). 8. He provided a copy of a social security card that shows his SSN as X32-xx-XXXX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, prescribed the separation documents that must be prepared for Soldiers on retirement, discharge, or release from active duty service or control of the Active Army. It established standardized policy for preparing and distributing the DD Form 214. The instructions stated to transcribe the SSN from the individual's DA Form 2139. DISCUSSION: The applicant's records contain a DA Form 3027 and Headquarters U.S. Army Personnel Center Far East, special orders that clearly show his SSN as X32-xx-XXXX.
