Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of item 3 (Social Security Number (SSN)) of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his correct SSN. 2. The applicant states the SSN listed on his DD Form 214 is incorrect. His correct SSN is 55x-xx-xxxx instead of 52x-xx-xxxx. 3. The applicant provides copies of his Veterans Administration (VA) and social security cards. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. The applicant was appointed a commissioned officer of the U.S. Army Reserve (USAR) in the rank of second lieutenant on 14 June 1968. He was ordered to active duty on 10 November 1968. 3. His Military Personnel Records Jacket (MPRJ) cover and DA Form 2-1 (Personnel Qualification Record) prepared upon his entry onto active duty lists his SSN as 55x-xx-xxxx. The majority of the documents maintained in his MPRJ show his SSN as 55x-xx-xxxx with a few documents showing his SSN as 52x-xx-xxxx. Letter Orders Number A-10-1427, dated 4 October 1968, issued by Headquarters, Sixth U.S. Army show his SSN as 55x-xx-xxxx. 4. On 7 September 1970, the applicant was honorably released from active duty and transferred to the USAR Control Group having completed 1 year, 9 months, and 28 days of creditable active service. He was issued a DD Form 214 showing in item 3 his SSN as 52x-xx-xxxx. 5. The applicant provides a copy of his social security card which list his SSN as 55x-xx-xxxx. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service. It is important that information entered on the form is complete and accurate. DISCUSSION: The applicant's Letter Orders Number A-10-1427 shows his SSN as 55x-xx-xxxx. This SSN is consistent with the SSN listed in the majority of the documents in his service record and the SSN listed on the social security card he provided.
