THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests correction of his DD Form 214 (Armed Forces of the United States Report of Transfer or Discharge) to show his social security number (SSN) as XXX-4X-XXXX instead of XXX-1X-XXXX. 2. The applicant states the SSN listed in item 3 of his DD Form 214 it is not his correct SSN. 3. The applicant provides a copy of his social security card and DD Form 214. CONSIDERATION OF EVIDENCE: 1. Title 10, U.S. Code, section 1552(b), provides that applications for correction of military records must be filed within 3 years after discovery of the alleged error or injustice. This provision of law also allows the Army Board for Correction of Military Records (ABCMR) to excuse an applicant's failure to timely file within the 3-year statute of limitations if the ABCMR determines it would be in the interest of justice to do so. While it appears the applicant did not file within the time frame provided in the statute of limitations, the ABCMR has elected to conduct a substantive review of this case and, only to the extent relief, if any, is granted, has determined it is in the interest of justice to excuse the applicant's failure to timely file. In all other respects, there are insufficient bases to waive the statute of limitations for timely filing. 2. On 6 January 1966, the applicant was inducted into the Army of the United States (AUS). His DD Form 47 (Record of Induction) shows his service number. His SSN is not listed on this form. 3. His record shows he signed a DD Form 41 (Record of Emergency Data). Item 9 (Social Security Number) showing his SSN as XXX-4X-XXXX. 4. His record does not contain a DA Form 2139 (Military Pay Voucher), which was the form used at the time as the primary source for the SSN entry on the DD Form 214. 5. On 18 October 1967, he was honorably released from active duty. His DD Form 214 shows his SSN as XXX-1X-XXXX. 6. The applicant provides his social security card, which shows his SSN as XXX-4X-XXXX. REFERENCES: Army Regulation 635-5 (Separation Documents), in effect at the time, established the standardized policy for preparing and distributing the DD Form 214. The purpose of the separation document is to provide the individual with documentary evidence of his or her military service at the time of release from active duty, retirement, or discharge and provides item 3 (Social Security Number) is transcribed from the DA Form 2139. DISCUSSION: 1. The applicant was inducted on 6 January 1966 and assigned a service number. His service number was the primary means of identification used throughout his period of military service. 2. Although his record is void of a military pay voucher, the SSN he claims as correct is recorded on a DA Form 41.
