THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests amendment of the residence address shown on his 2015 mobilization orders from "El Paso, TX" to "Upland, CA." 2. The applicant states on 9 January 2015 the 85th Regional Support Command (RSC) published Orders UZ-009-0028 listing his address as "67xx Mor____ Cir, El Paso, TX, 79904." This is incorrect. He married an active duty service member (Staff Sergeant (SSG) Den__ Cas__ Wal__). His spouse was transferred on a permanent change of station from El Paso, TX, to Upland, CA, in accordance with Orders R-03-58256, issued by the U.S. Army Human Resources Command (HRC) on 17 March 2015. He and his spouse leased a house for permanent residence on 12 June 2015. He moved to temporary change of station housing on 24 July 2015. He wants Orders UZ-009-0028 to reflect his address as "13xxxx Zi__ Avenue, Chino, CA 91710," effective 12 June 2015. 3. The applicant provides: * Orders UZ-009-0028, dated 9 January 2015 * Orders R-03-582567 (his spouse), dated 17 March 2015 * Unaccompanied Personnel Housing Statement, dated 24 July 2015 * Assignment of Unaccompanied Housing * Housing Data Sheet for TCS (Temporary Change of Station) Occupants * Residential Lease CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the U.S. Army Reserve (USAR) at the New York (NY) Military Entrance Processing Station (MEPS) on 11 December 1985. He listed his home of record (HOR) as Brooklyn, NY. 2. He held military occupational specialty (MOS) 63B (Light Wheel Vehicle Mechanic) and served with a troop program unit (TPU) of the USAR. He was honorably discharged from the USAR on 29 March 1993. 3. He again enlisted in the USAR on 19 April 1994, at the NY MEPS. He listed his HOR as Staten Island, NY. He also reenlisted on 19 April 1995 and again listed his HOR as Staten Island, NY. 4. In April 1999, he transferred to the 1015th Maintenance Company in Forest Park, GA, and resided in Riverdale, GA. He then reenlisted in the USAR on 8 April 2010, while assigned to Fort McClellan, AL. He listed his HOR as Riverdale, GA. 5. He was ordered to active duty on 29 October 2001, from Anniston, AL, and subsequently served in Afghanistan from May to December 2002. He was honorably released from active duty on 26 September 2003. His DD Form 214 (Certificate of Release or Discharge from Active Duty) for this period listed in: * Item 7a (Place of Entry Into Active Duty), Anniston, AL * Item 7b (HOR at Time of Entry), LeGrange, GA 30240 6. He reenlisted indefinitely in the USAR at Fort McClellan, AL on 19 September 2006. He listed his HOR as Union City, GA. He transferred to another TPU in Decatur, IL, in November 2006, and a second TPU in Springfield, IL, in October 2007. 7. On 29 January 2009, HRC issued him a Notification of Eligibility for Retired pay at Age 60 (20-Year Letter). The notification listed his address in South Bend, IN. 8. He entered active duty from Granger, IN, on 1 October 2009. He was honorably released from active duty on 28 March 2010. His DD Form 214 for this period of service shows in: * Item 7a, the place of entry on active duty as Granger, IL * Item 7b, his HOR at time of entry on active duty as Granger, IN 9. In October 2010, he was reassigned to another TPU of the USAR in Staten Island, NY, and in February 2012, he was assigned to the 1179th Transportation Brigade at Fort Hamilton, NY. 10. On 24 October 2013, he was reassigned to the 2206th Mobilization Support Battalion, Fort Bliss, TX. 11. On 9 January 2015, Headquarters, 85th RSC, Arlington Heights, IL, published Orders UZ-009-0028 (contested orders) ordering him to active duty for 365 days. These orders listed: * his residence as "67xx Mor____ Cir, El Paso, TX 79904" * his unit as 2206th Mobilization Support Battalion, Fort Bliss, TX * his HOR as El Paso, TX 12. On 25 February 2015, he completed a DD Form 5960 (Authorization to Start, Stop, or Change Basic Allowance for Quarters (BAQ), and/or Variable Housing Allowance). He indicated he was married as of 25 September 2007 and had a dependent child. He listed his address with his spouse and child as "62XX Mor___ Circle, El Paso, TX 79904." 13. He entered active duty on 20 February 2015. He served with various units at Fort Bliss, including the 642nd Regional Support Group. 14. On 8 June 2017, Headquarters, U.S. Army Garrison, Fort Bliss, published Orders 159-0028 ordering his release from active duty and transfer to the 642nd Regional Support Group, Decatur, GA. These orders listed his HOR as "Chino, CA" and the place entered active duty as "El Paso, TX." 15. He was honorably released from active duty on 25 May 2017. His DD Form 214 for this period shows in: * Item 7a, the place of entry on active duty as El Paso, TX * Item 7b, his HOR at time of entry on active duty as El Paso, TX 16. He provides: a. Orders R-03-58256, issued by HRC on 17 March 2015, ordering the reassignment of SSG Cas__ Den__ Wal__, releasing her from Fort Bliss, TX and reassigning her to the 315th Tactical Psychological Operations Company, Upland, CA on 29 June 2015. b. Unaccompanied Personnel Housing Statement, dated 24 July 2015, explaining the liability for damage to assigned housing. c. Memorandum, showing the applicant was assigned unaccompanied housing effective 27 July 2015. d. Housing Data Sheet for TCS Occupants, dated 24 July 2015. e. Residential Lease between the applicant, Cas__ Den__ Wal__, three children, and the a landlord in Chino, CA, for a 12-month lease beginning on 13 June 2015 and terminating on 12 June 2016. REFERENCE: 1. Army Regulation 635-8 (Separation Processing and Documents) prescribes policy and procedural guidance relating to transition management. The DD Form 214 is a summary of the Soldier’s most recent period of continuous active service. A DD Form 214 will be prepared for various categories of Soldiers. Chapter 5 provides detailed instructions for data required in each block on the DD Form 214. Block 7 reflects the Place of Entry into Active Duty and HOR: a. Block 7a, the Place of Entry into Active Duty. A Soldier’s initial enlistment contract or order to active duty is the source document for this data. Enter the city and state where the Soldier entered active duty. Regular Army enlisted Soldiers normally enter active duty at the MEPS. b. Block 7b, HOR. A Soldier’s initial enlistment contract or appointment document is the source for this data, or any correction approved by HRC. List the street address, city, state, and zip code listed as the Soldier's HOR. For Reserve Component Soldiers, the active duty order lists the Soldier’s HOR. The HOR is the place recorded as the HOR of the Soldier when commissioned, appointed, enlisted, or ordered to a tour of active duty. This cannot be changed unless there is a break in active service of at least 1 full day, or it is determined by HRC to be factually incorrect. An HOR is not necessarily the same as the legal domicile as defined for income tax purposes. Legal domicile may change during a Soldier’s career. 2. Army Regulation 600-8-105 (Military Orders) prescribes the policies and mandated operating tasks for the orders program of the Military Personnel System. It establishes standards and provides an operational document in a logical sequence. Paragraph 14-5 (Mobilization-related formats) contains formats (Table 14–2) for preparing mobilization-related orders at all echelons of Active Army and Reserve Component organizations. DISCUSSION: 1. The applicant was assigned to the 2206th Mobilization Support Battalion, Fort Bliss, TX, on 24 October 2013. On 9 January 2015, Headquarters, 85th RSC, published Mobilization Orders UZ-009-0028 (contested orders) ordering him to active duty for 365 days. These orders show he was to report from home of residence to the mobilization station on 20 February 2015. 2. These orders listed his residence as "67xx Mor____ Cir, El Paso, TX 79904" because that is where he resided at the time. On 25 February 2015, he completed a DD Form 5960 requesting BAQ or basic allowance for housing based on his address in El Paso, TX. 3. He may have signed a lease in Chino, CA, with his spouse in June 2016, but he did not reside in CA at the time he was mobilized in February 2015.
