Military Personnel Records and advisory opinions (if any). THE APPLICANT'S REQUEST, STATEMENT, AND EVIDENCE: 1. The applicant requests, in effect, removal of Headquarters, 11th Air Defense Artillery Brigade, Permanent Order 43-01, dated 13 February 2013, from her Official Military Personnel File (OMPF). 2. The applicant states: a. She requests removal of the disqualification statement for award of the Army Good Conduct Medal (AGCM) from her file. The statement should have amended the orders for her second AGCM, not revoked it. b. She was awarded an AGCM for her prior service after she received the first award of the AGCM for her current service. c. She does not want the disqualification statement in her records because it indicates she has two awards of the AGCM, not three. This would not match her records and uniform. 3. The applicant provides a copy of Headquarters, 11th Air Defense Artillery Brigade, Permanent Order 43-01, dated 13 February 2013. CONSIDERATION OF EVIDENCE: 1. The applicant enlisted in the Regular Army on 22 February 2002 for a period of 4 years. She was honorably discharged on 30 September 2004 by reason of pregnancy. She completed 2 years, 7 months, and 9 days of active service during this period. 2. She again enlisted in the Regular Army on 2 April 2008 and she is currently serving in the rank of staff sergeant. 3. Her records contain the following orders pertaining to award of the AGCM: a. 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 109-03, dated 19 April 2011, awarded her the AGCM (1st Award) for the period 23 August 2005 through 2 April 2011; b. 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 117-01, dated 27 April 2011, awarded her the AGCM (1st Award) for the period 3 April 2008 through 2 April 2011; c. Headquarters, 11th Air Defense Artillery Brigade, Permanent Orders Number 30-01, dated 30 January 2013, awarded her the AGCM (1st Award) for the period 22 February 2002 through 30 September 2004; d. Headquarters, 11th Air Defense Artillery Brigade, Permanent Order 43-01, dated 13 February 2013, revoked Headquarters, 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 109-03, dated 19 April 2011 e. Headquarters, 5th Battalion, 52d Air Defense Artillery Regiment, Permanent Orders 93-49, dated 3 April 2014, awarded her the AGCM (3rd Award) for the period 3 April 2011 through 2 April 2014; f. Headquarters, 1st Battalion, 34th Infantry Regiment, Orders 095-01, dated 4 April 2016, revoked 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 117-01, dated 27 April 2011; and g. Headquarters, 1st Battalion, 34th Infantry Regiment, Permanent Orders 095-02, dated 4 April 2016, awarded her the AGCM (2nd Award) for the period 3 April 2008 through 2 April 2011. REFERENCES: 1. Army Regulation 600-8-22 (Military Awards) prescribes Army policy, criteria, and administrative instructions concerning individual and unit military awards. The AGCM is awarded to individuals who distinguish themselves by their conduct, efficiency, and fidelity. This period is 3 years except in those cases when the period for the first award ends with the termination of a period of active Federal military service. Although there is no automatic entitlement to the AGCM, disqualification must be justified. 2. Army Regulation 600-8-104 (Army Military Human Resource Records Management) provides policies, operating tasks, and steps governing the OMPF. Appendix B (Documents Required for Filing in the Army Military Human Resource Record and/or Interactive Personnel Electronic Records Management System) shows award and revocation orders are filed in the performance folder of the OMPF. DISCUSSION: 1. The applicant completed a qualifying period of service for the first award of the AGCM during her initial enlistment from 22 February 2002 through 30 September 2004 (2 years, 7 months, and 9 days ending with termination of active Federal military service). However, she was not awarded the AGCM (1st Award) at that time. This appears to have been an administrative oversight. 2. During her subsequent enlistment, she completed a second qualifying period of service from 2 April 2008 through 1 April 2011 (3 years). However, she was awarded the AGCM (1st Award) for the period 3 April 2008 through 2 April 2011 (beginning and ending dates off by 1 day). 3. She completed a third qualifying period of service from 2 April 2011 through 1 April 2014 (3 years). However, she was awarded the AGCM (3rd Award) for the period 3 April 2011 through 2 April 2014 (beginning and ending dates off by 1 day). 4. It appears that her subsequent units detected the omission of her first qualifying period and attempted to rectify the situation by revoking the orders awarding her the AGCM (1st Award) for the period 3 April 2008 through 2 April 2011 and the AGCM (1st Award) for the period 23 August 2005 through 2 April 2011, issuing orders awarding her the AGCM (1st Award) for the period 22 February 2002 through 30 September 2004, and issuing orders awarding her the AGCM (2nd Award) for the period 3 April 2008 through 2 April 2011 (beginning and ending dates off by 1 day). 5. The evidence of record shows three separate orders awarded her the AGCM (1st Award), two of which were then revoked. Although regulatory guidance states to file award and revocation orders in the performance folder of the OMPF, the two erroneous orders and the revocation orders offer no relevant information regarding the applicant's service, conduct, or duty performance. Removing these orders eliminates the potential for confusion by officials authorized to review her OMPF. 6. The evidence supports removing the following orders from her OMPF: a. 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 109-03, dated 19 April 2011; b. 6th Engineer Battalion (Combat) (Airborne), Permanent Orders Number 117-01, dated 27 April 2011; c.
