2.  The Board determined the evidence presented is sufficient to warrant amendment of the decision of the Army Board for Correction of Military Records set forth in Docket Number AR20150004729, dated 11 February 2016, to show:

* his spouse properly concurred with his election not to participate in the SBP in a timely manner
* the election was received, approved, and timely processed
* he is entitled to reimbursement for any SBP premiums he may have paid as a result of these corrections

THE BOARD CONSIDERED THE FOLLOWING EVIDENCE:

CONSIDERATION OF ADDITIONAL EVIDENCE:

6.  On 25 February 2016, new information was received from the applicant's spouse regarding the decision of the Army Board for Correction of Military Records (ABCMR) in Docket Number AR20150004729, dated 11 February 2016.

7.  The evidence submitted consists of a notarized copy of spousal concurrence to terminate Survivor Benefit Plan (SBP) coverage.

ADDITIONAL DISCUSSION:

7.  At the time of the decision of the ABCMR in Docket Number AR20150004729 on 11 February 2016, it was the intent of the ABCMR to make the applicant's record as administratively correct as it should properly have been at the time.

8.  The evidence considered in ABCMR Docket Number AR20150004729 did not contain the required written spousal concurrence to terminate SBP coverage as requested by the applicant.

9.  Based on receipt of the written spousal concurrence to terminate SBP coverage, it would be in the interest of equity to correct the applicant's records to show his request to cancel SBP coverage was made in a timely fashion.
